AN ORDINANCE AMENDING SECTION 25-4 OF CHAPTER 25 -- SWIMMING
POOLS BY CHANGING THE TITLE TO READ SWIMMING POOLS AND PATIOS
AND AMENDING THE SETBACK REQUIREMENTS OF TAMARAC'S CITY CODE
PERTAINING TO SWIMMING POOL AND PATIO INSTALLATION REGULATIONS
AND REQUIREMENTS; PROVIDING SEVERABILITY OF INVALID PROVISIONS;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Tamarac, Florida, believes
that it is desirable to amend portions of Chapter 25 - Swimming Pools, related
to the setback requirements and other regulations,
FLORIDA:
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
SECTION 1: Chapter 25, Swimming Pools, of Tamarac's Code of Ordinances
is hereby amended by adding Patios to the title to read as follows: Chapter 25
Swimming Pools and Patios.
SECTION 2: The Table of Contents of Tamarac's Code of Ordinances is
hereby amended by adding Patios to the title of Chapter 25.
SECTION 3: Chapter 25, Swimming Pools and Patios of Tamarac's Code of
Ordinances, Section 25-4 Setback Requirements is hereby amended by deleting the
following words and adding thereto the new underlined words as follows:
(a) Pools or Patios without structural roofs covered only
with open mesh screening may be placed in a required side or rear setback area
subject to the limitations set forth below. In no case shall a pool or covered
ap do be placed in a required street front yard or street side yard setback.
(b) Ariy-part-ef-a Pools or Patios which #s are covered by a
structural roof or enclosed by side walls shall be subject to the same limitations
on location as the primary building and shall not be placed in tine any setback area.
(c) All parts of a pool without a structural roof including

a structural deck, cap and/or mechanical equipment, or--a-peso covered with only
open mesh screening may be placed within the required side or rear setback area
but shall be no closer than five (5) feet from a property line. In no case
shall there be encroachment into a utility or drainage easement of record unless
waivers are granted by the appropriate authorities. The height of the open mesh
screening shall not extend more than fifteen (15) feet above the slab of the
building.
(d) In multiple family zoning districts, single story
residential buildings and two story townhouses shall be permitted a
single story patios without solid walls in the rear setback when adjacent to S--1
zoned property in accordance with the following conditions:

(e) The owner of any property refused or denied a
building permit by an Officer of the City may apply to the Board of Adjustment
for a variance in any case where it can be demonstrated that the enforcement of
this section would create an undue hardship. The fee for such applications shall
be one hundred fifty dollars ($150.00). (Ordinance No. 76--36, J 1, 7026-76).
SECTION 4: Specific authority is hereby granted to codify this
Ordinance.
SECTION 5: All Ordinances or parts of Ordinances in conflict herewith
are hereby repealed to the extent of such conflict.
SECTION 6: Should any section or provision of this Ordinance or any
portion thereof, or any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the validity

of the remainder hereof as a whole or any part hereof, other than the part
delcared to be invalid.
SECTION 7: This Ordinance shall become effective immediately upon its
final passage.
