D~ J,3 - 9 Temp, # 1006 Revised 3/23/83 AN ORDINANCE OF THE CITY OF TAMARAC AMENDING CHAPTER 6, BEAUTIFICATION SECTION 6-12, MINIMUM LANDSCAPING REQUIRE- MENTS IN COMMERCIALLY ZONED DISTRICTS (B-1, B-2, B-3, B-5, B-6, I-1 AND R-5), SUB -SECTION (a), REQUIRED LANDSCAPING ADJACENT TO STREET RIGHTS -OF -WAY BY INCREASING THE MINIMUM CRITERIA FOR DEVELOPING ADJACENT TO TRAFFIC - WAYS OR THOROUGHFARES WITH SPECIFIC CRITERIA FOR ACCEPTABLE CONSTRUCTION MATERIALS PERMITTED THEREIN; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Tamarac has determined that it is desirable to increase the landscape requirements of commercial developments adjacent to wee t rights -of -way, and WHEREAS, the City of Tamarac's Comprehensive Land Use Plan has been determined to be consistent -with the following amendment: NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Code of the City of Tamarac is hereby amended by substituting a new Sub -Section (a) to Section 6-12, Minimum Land- scape Requirements in commercial zoned districts (B-1, B-2, B-3, B-5, B-6, I-1 and R-5) of Chapter 6, Beautification, to read as follows: (a) Required Landscaping Adjacent to Street Rights -of -Way shall be constructed and maintained in accordance with- the_____ - following standards: 25 TYPE OF ROADWAY WIDTH OF LANDSCAPE BUFFER 26 27 1. All other rights -of -way 10.011 28 ag (A) One acceptable shade tree with a minimum height of 3 fifteen (15) feet per thirty (30) lineal feet or fraction thereof with a 31 minimum D.B.H. (B) A minimum of 752 of the lineal strip shall be screened to a minimum height of three (3) feet above the crown of the ad- jacent street. Screening for the purposes of this section on 20' buffer strips shall consist of meandering berms or other architecutural treatments determined by the city council to be consistent with the overall goals pertaining to the aesthetic environment of _the neighborhood. Screening on 10' buffer strips_shall_ consist of 36" high hedges maintained in healthy condition or 36" high solid masonry walls. (C) The remaining area of the lineal strip shall consist of either acceptable ingress/egress drives or an approved hedge planted adjacent to the interior edge of the landscape strip a minimum of thirty (30) inches high and maintained at a height of thirty-six (36) inches to forty-two (42) inches. (2) In addition, the landscape strip shall be land- scaped with sod, ground cover or other landscape treatment excluding paving. The swale area between the property line and street pavement shall be sodded. (3) The trees near where the accessways intersect with the street right-of-way shall be placed so that they do not obstruct the visability of existing traffic. They also should have the limbs and foliage kept trimmed to five (5) feet minimum height from the ground. (4) No more than one two-way accessway (thirty-five (35) feet maximum) for any street frontage up to one hundred (100) lineal feet or not more than two one-way accessways (sixtPan (16) feet wide maximum) shall be permitted for any street frontage up to one hundred (100) lineal feet. Any additional accessways permitted for frontage greater than one hundred (100) lineal feet shall be at the discretion of the City Council, with the recommendation of the Planning Commission and the City Engineer taken into consideration. (6) At the intersection of two streets or a street and a driveway, all landscaping, berms and architectural treatments shall not be placed in the visibility triangle formed by measuring 25' from the intersection along each right-of-way/property line. SECTION 2: Al Ordinances or of Ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 3: 'Should any section or provision of this Ordinance cr any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the parr declar- ed to be invalid.
