CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0--8 3-_/,f5 _
AN ORDINANCE VACATING PORTIONS OF TWO
UTILITY EASEMENTS WITHIN LOT 4, BLOCK 50,
WOODLANDS SECTION ONE, PHASE TWO, AS
RECORDED IN PLAT BOOK 67, PAGE 23, OF THE
PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA;
PROVIDING FOR SEVERABILITY OF INVALID PRO-
VISIONS: AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COU14CIL OF THE CITY OF TAIv1ARAC, FLORIDA:
SECTION 1: FINDINGS OF FACT: A determination is hereby made
by the City Council that the portions of two utility easements
described on Exhibits A, B and C are no longer needed for public
purposes and, accordingly, the easement interest should revert to the
private party(ies) owning the property burdened by the easement to be
vacated.
SECTION 2: The portions of the two utility easements described
in Exhibits A, B and C attached hereto and made a part hereof, are
hereby abandoned, vacated and extinguished by the City Council of the
City of Tamarac, Florida, and such portions of these easements shall
no longer be deemed property to be used for public purposes on behalf
of the people of the City of Tamarac, Florida.
SECTION 3: Should any section or provision of this Ordinance or
any portion thereof, or any paragraph, sentence or word be declared by
a Court of competent jurisdiction to be invalid, such decision shall
not a-fect the validity of the remainder hereof as a whole or any part
hereof, other than the part declared to be invalid.
SECTION 4: This Ordinance shall become effective upon final
adoption.
