AN ORDINANCE AMENDING SECTIONS 23-12 AND 13 OF THE
CITY CODE REGARDING FEES FOR EXCAVATIONS OR CUTS
OF CURBS, STREETS OR MEDIANS, REPEALING THE
EXISTING FEE SCHEDULE; PROVIDING FOR THE CITY 4
COUNCIL TO BE AUTHORIZED TO ESTABLISH A FEE
SCHEDULE BY RESOLUTION; AMENDING THE SPECIFICA-
TIONS FOR RESTORATION; PROVIDING FOR CODIFICATION;
PROVIDING REPEALER; PROVIDING FOR SEVERABILITX OF
INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Section 23-12 of the City Code presently sets out
certain fees for permits for excavations and cuts of City curbs, streets and
medians; and
WHEREAS, the City Council wishes to continue to require fees for
such permits but wishes to establish such fees by Resolution; and
W EPXAS, the City Council wishes to make other editorial changes
to Sections 23-12 and 23-13 of the City Code,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION l: That Section 23-12 of the City Code is hereby
Amended to provide as follows:
" Sec. 23-12. Fees, miscellaneous regulations.
(a) Fees. The applicant for said permit shall pay tp the
City as a permit fee a sum in accordance with the-te44ew4iig-sehede.4e:a schedule
established by Resolution of the City Council. Said fee schedule available at
the office of the City Clerk for purchase by the public.

(b) fe3 Fees for commencing work without permit, etc.
Except for emergencies, the above permit fees shall be doubled if work commences
before a permit is issued to the applicant. If the street opening is covered
before test samples have been taken or the City Engineer has granted permission,
he may order the backfill and/or restoration work removed for whatever testing
and inspection he requires. Permits expire sixty (60) calendar days following
issuance; provided however one thirty -day extension may be granted for good
cause by the City Engineer.
(c) ff3 Utility companies. Utility companies whose
franchise agreement with the City provides for the deduction of permit and/or
inspection fees and/or costs from time to time may obtain permits without the
payment of fees therefor.
(d) fg3 Definitions. For the purpose of this section,
"street" shall mean the entire public right-of-way, whether paved or not, and
"street cut" shall mean any excavation within, on or under the street, and
including boring and jacking operations.

25 SECTION 3: That specific authority is hereby granted to codify

SECTION 4: That all Ordinances or parts of Ordinances in conflict

herewith are hereby repealed to the extent of such conflict.

0 SECTION 5: That should any section or provision of this Ordinance
1 or any portion thereof, or any paragraph, sentence or word be declared by a
32 Court of competent jurisdiction to be invalid, such decision shall not affect
