ORDINANCE NO. C - JF-;57_/7
AN ORDINANCE VACATING A ROAD RIGHT-OF-WAY
WITHIN LAND SECTIONS 4 AND 5, TOWNSHIP 49
SOUTH, RANGE 41 EAST, TRACT 63, AS REQUESTED
BY CITY NATIONAL BANK OF MIAMI, AS TRUSTEE,
AND TRACT 76 CORP.; PROVIDING FOR SEVERABILITY
OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAI;FRAC, FLORIDA:
SECTION 1: FINDINGS OF FACT: A determination is hereby made by the City
Council that the road right-of-way described on Exhibit "A" is no longer needed for
public purposes and, accordingly, the road right-of-way interest should revert to
the private party(ies) owning the property burdened by the road right-of-way to be
vacated.
SECTION 2: The road right-of-way described in Exhibit "A", attached hereto
and made a part hereof, is hereby abandoned, vacated and extinguished by the City
Council of the City of Tamarac, Florida, and such road right-of-way shall no longer
be deemed property to be used for public purposes on behalf of the people of the
City of Tamarac, Florida.
SECTION 3: Should any section or provision of this Ordinance or any portion
thereof, or any paragraph, sentence or word be declared by a Court of competent
jurisdiction to be invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the part declared to be
invalid.
SECTION 4: This Ordinance shall become effective upon final adoption.

thereof as recorded in Plat Book 1, Page 102 of the Public Records
of Palm Beach County, Florida, and portions of FORT LAUDERDALE
TRUCK FARMS SUBDIVISION of Section 4, Township 49 South, Range 41
East, according to the Plat thereof as recorded in Plat Book 4,
Page 31 of the Public Records of Broward County, Florida,
described as follows:
COMMENCING at the Southwest corner of said Section 4, thence North
000 10' 05" West, along the Section line common to said Sections 4
and 5, a distance of 3366.24 feet to the POINT OF BEGINNING;
thence northwesterly 16.67 feet along the arc of a curve, concave
to the Southwest, having a radius of 320.00 feet, a delta of 020
59' 06", and subtended by a chord having a length of 16.67 feet
and a bearing of North 64' 18' 13" West; thence North 00° 10' 05"
West, along a line parallel with and 15.00 feet West of the East
boundary of Section 5, a distance of 372.81 feet; thence North 710
45' 49" East, 31.56 feet; thence South 00' 10' 05" East, along a
line parallel with and 15.00 feet East of the West boundary of
Section 4, a distance of 398.15 feet to a point on the arc of a
non -tangent curve; thence northwesterly, 17.13 feet along the arc
of said curve, concave to the Southwest, having a radius of 320.00
feet, a delta of 03° 04' 04" and subtended by a chord having a
length of 17.13 feet and a bearing of North 61' 16' 38" West, to
the Point of Beginning;

5, a distance of 3988.54 feet to the POINT OF' BEGINNING; thence

along a line parallel with and 15.00 feet West of the East bound-

Said lands lying in the City of Tamarac, Broward County, Florida,
and containing 0.64 acre, more or less.
