3 AN ORDINANCE VACATING A ROAD RIGHT--OF-WAY
WITHIN LAND SECTION 5, TOWNSHIP 49 SOUTH,
4 RANGE 41 EAST, TRACT 57, AS REQUESTED BY
CITY NATIONAL BANK OF MIAMI, AS TRUSTEE, AND
5 TRACT 76 CORP.; PROVIDING FOR SEVERABILITY
OF INVALID PROVISIONS; AND PROVIDING AN EFFEC-
TIVE DATE.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: FINDINGS OF FACT: A determination is hereby made by the City
Council that the road right-of-way described on Exhibit "A" is no longer needed for
public purposes and, accordingly, the road right-of-way interest should revert to
the private party(ies) owning the property burdened by the road right-of-way to be
vacated.
SECTION 2: The road right-of-way described in Exhibit "A", attached hereto
and made a part hereof, is hereby abandoned, vacated and extinguished by the City
Council of the City of Tamarac, Florida, and such road right-of-way shall no longer
be deemed property to be used for public purposes on behalf of the people of the
City of Tamarac, Florida.
SECTION 3: Should any section or provision of this Ordinance or any portion
thereof, or any paragraph, sentence or word be declared by a Court of competent
jurisdiction to be invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the part declared to be
invalid.
SECTION 4: This Ordinance shall become effective upon final adoption.

RIGHT-OF-WAY VACATION
WOODMONT TRACT 57
A portion of WOODMONT TRACT 57, according to the Plat
thereof as recorded in Plat Book 107, Page 25 of the Public
Records of Broward County, Florida, described as follows:
BEGINNING at the intersection of the East boundary of Sec-
tion 5, Township 49 South, Range 41 East, Broward County,
Florida, with the North boundary of said WOODMONT TRACT 57,
thence South 00' 10' 05" East, along said East boundary of
Section 5, a distance of 625.66 feet to a point on the
South boundary of Lot 61, said WOODMONT TRACT 57; thence
North 770 00' 00" West, along said South boundary, 15.41
feet; thence North 000 10' 05" West, along a line parallel
with and 15.00 feet West of the East boundary of said Sec-
tion 5, a distance of 622.32 feet to a point on the North
boundary of said WOODMONT TRACT 57; thence South 89" 32'
12" East, along said North boundary, 15.00 feet to the
Point of Beginning.
TOGETHER WITH
A portion of said WOODMONT TRACT 57, described as follows:
COMMENCING at the aforedescribed intersection of the East
boundary of said Section 5 with the North boundary of said
WOODMONT TRACT 57, thence South 00° 10' 05" East, along
said East boundary of Section 5, a distance of 802.98 feet
to the POINT OF BEGINNING on the North boundary of Lot 73,
said WOODMONT TRACT 57; thence continue South 00° 10' 05"
East, along said East boundary of Section 5, a distance of
423.26 feet to a point on the southerly boundary of Lot 88,
said WOODMONT TRACT 57; thence along said southerly bound-
ary; North 43° 54' 30" West, 3.79 feet; thence continuing
along said southerly boundary, WEST, 12.38 feet; thence
North 00° 10' 05" West, along a line parallel with and
15.00 feet West of the East boundary of said Section 5, a
distance of 426.05 feet to a point on the North boundary of
said Lot 73, WOODMONT TRACT 57; thence along said North
boundary, South .690 49' 05" East, 16.00 feet to the Point
of Beginning.
Said lands lying in. the City of Tamarac, Broward County,
Florida, and containing 15,713 square feet, or 0.3607 acres
more or less.
