HomeMy WebLinkAboutCity of Tamarac Ordinance O-1983-0251 2 3 4 5 8 9 10 11 12 13 14 15 16 17 20 21 22 23 24 25 26 27 28 29 30 Introduced by Temp. # 1040 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-S7�� AN ORDINANCE VACATING A ROAD RIGHT -OF --WAY WITHIN LAND SECTION 4, TOWNSHIP 49 SOUTH, RANGE 41 EAST, TRACT J - SOUTH GOLF COURSE, AS REQUESTED BY CITY NATIONAL BANK OF MIAMI, AS TRUSTEE, AND TRACT 76 CORP.; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: FINDINGS OF FACT: A determination is hereby made by the City Council that the road right-of-way described on Exhibit "A" is no longer needed for public purposes and, accordingly, the road right-of-way interest should revert to the private party(ies) owning the property burdened by the road right-of-way to be vacated. SECTION 2: The road right-of-way described in Exhibit "A", attached hereto and made a part hereof, is hereby abandoned, vacated and extinguished by the City Council of the City of Tamarac, Florida, and such road right-of-way shall no longer be deemed property to be used for public purposes on behalf of the people of the City of Tamarac, Florida. SECTION 3: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be I invalid. SECTION 4: This Ordinance shall become effective upon final adoption.
