TY OF TAMARAC, FLORIDA
ORDINANCE NO.
AN ORDINANCE VACATING A ROAD RIGHT-OF-WAY
WITHIN LAND SECTION 41 TOWNSHIP 49 SOUTH;
RANGE 41 EAST, TRACT 68, AS REQUESTED BY
CITY NATIONAL BANK OF MIAMI, AS TRUSTEE,
AND TRACT 76 CORP.; PROVIDING FOR SEVERABILITY
OF INVALID PROVISIONS; AND PROVIDING AN EFFEC-
TIVE DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: FINDINGS OF FACT: A determination is hereby made by the City
Council that the road right-of-way described on Exhibit "A" is no longer needed for
public purposes and, accordingly, the road right-of-way interest should revert to
the private party(ies) owning the property burdened by the road right-of-way to be
vacated.
SECTION 2: The road right-of-way described in Exhibit "A", attached hereto
and made a part hereof, is hereby abandoned, vacated and extinguished by the City
Council of the City of Tamarac, Florida, and such road right-of-way shall no longer
be deemed property to be used for public purposes on behalf of the people of the
City of Tamarac, Florida.
SECTION 3: Should any section or provision of this Ordinance or any portion
thereof, or any paragraph, sentence or word be declared by a Court of competent
jurisdiction to be invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the part declared to be
invalid.
SECTION 4: This Ordinance shall become effective upon final adoption.

SION of Section 4, Township 49 South, Range 41
East, according to the Plat thereof as recorded in
Plat Book 4, page 31 of the Public Records of
Broward County, Florida, described as follows:
COMMENCING at the Northwest corner of Section 4,
Township 49 South, Range 41 East; thence South 00'
10' 05" East along the West boundary of said Sec-
tion 4, a distance of 5205.72 feet to the POINT OF
BEGINNING (Said point also being on the West
Right -of --way line of that certain canal
Right--of-way as recorded in Official Records Book
6450, page 688 of the Public Records of Broward
County, Florida); thence South 25' 36' 06" East,
along said Right-of-way line, 34.93 feet; thence
South 00' 10' 05" East along a line 15.00 feet East
of and parallel with the Jest boundary of aforesaid
Section 4, a distance of 1619.77 feet to a point on
the East Right -of --way line of Northwest 88th Avenue
as recorded in Official Records Book 4747, page 183
of the Public Records of Broward County, Florida,
said point also being a point on the are of a
non -tangent curve (radial line thru said point
bears South 79' 44' 02" West); thence Northerly
along said Right -of --way line and along the are of
said curve being concave to the West having a
radius of 2453.00 feet, a delta of 01' 50' 02", an
arc distance of 78.51 feet to a point on the West
boundary of aforesaid Section 4; thence North 00'
10' 15" West along said West boundary, 1574.25 feet
to the POINT OF BEGINNING.
Said lands lying in the City of Tamarac, Broward
County, Florida and containing 23,939 square feet
or 0.5496 acres, more or less.
