AN ORDINANCE VACATING A ROAD RIGHT--OF-WAY
WITHIN LAND SECTION 5, TOWNSHIP 49 SOUTH,
RANGE 41 EAST, TRACT 68, AS REQUESTED BY
CITY NATIONAL BANK OF MIAMI, AS TRUSTEE,
AND TRACT 76 CORP.; PROVIDING FOR SEVERABILITY
OF INVALID PROVISIONS; AND PROVIDING AN EFFEC-
TIVE DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: FINDINGS OF FACT: A determination is hereby made by the City
Council that the road right-of-way described on Exhibit "A" is no longer needed for
public purposes and, accordingly, the road right-of-way interest should revert to
the private party(ies) owning the property burdened by the road right-of-way to be
vacated.
SECTION 2: The road right-of-way described in Exhibit "A", attached hereto
and made a part hereof, is hereby abandoned, vacated and extinguished by the City
Council of the City of Tamarac, Florida, and such road right-of-way shall no longer
be deemed property to be used for public purposes on behalf of the people of the
City of Tamarac, Florida.
SECTION 3: Should any section or provision of this Ordinance or any portion
thereof, or any paragraph, sentence or word be declared by a Court of competent
jurisdiction to be invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the part declared to be
invalid.
SECTION 4: This Ordinance shall become effective upon final adoption.

A portion of FLORIDA FRUIT LANDS CO. SUB. NO. 2,
according to the Plat thereof as recorded in Plat
Book 1, page 102 of the Public Records of Palm
Beach County, Florida, described as follows:
COMMENCING at the Northeast corner of Section 5,
Township 49 South, Range 41 East; thence South 000
10' 05" East along the East boundary of said Sec-
tion 5, a distance of 5205.72 feet to the POINT OF
BEGINNING (Said point also being on the West
Right -of --way line of that certain canal.
Right-of-way as recorded in Official Records Book
6450, page 688 of the Public Records of Broward
County, Florida); thence continue South 00° 10' 05"
East, along aforesaid East boundary of Section 5, a
distance of 1574.25 feet to a point on the East
right-of-way line of Northwest 88th Avenue, as
recorded in Official Record Book 4747, Page 183, of
the Public Records of Broward County, Florida,
said point also being on the arc of a non -tangent
curve (radial line thru said point bears South 77°
54' 00" West); thence northerly along said
right--of-way line and along the arc of said curve
being concave to the West, having a radius of
2453.00 feet, a delta of 01' 351 25", an arc
distance of 68.09 feet; thence North 00° 10' 05"
West, along a line 15.00 feet West of and parallel
with aforesaid East boundary of Section 5, a
distance of 1539.38 feet to a point on aforesaid
Canal West right--of-way line; thence South 250 36'
06" East, along said right-of-way line, 34.93 feet
to the Point of Beginning.
Said lands lying in the City of Tamarac, Broward
County, Florida and containing 23,341 square feet
or 0.5358 acres, more or less.
