AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA,
AMENDING CHAPTER 15 OF THE CODE OF ORDINANCES
OF THE CITY OF TAMARAC TO ADD A FINE FOR PARKING
ILLEGALLY IN A SPACE RESERVED FOR HANDICAPPED
PARKING; PROVIDING FOR CODIFICATION; PROVIDING
REPEALER; PROVIDING FOR SEVE ABILITY OF INVALID
PROVISIONS: AND PROVIDING AN EFFECTIVE DATE.

RE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That Chapter 15, Article II of the City Code is
hereby Amended by creating Section 15-5.1 to provide as follows:
"SECTION 15-5.1 Parking Places for Handicapped
A. Definitions.
1. Designated parking space: Any parking
space posted with a sign with lettering such as "Parking by Disabled Permit
Only," and bearing the internationally accepted wheelchair symbol.
2. Handicapped Person: A sevexey physically
disabled individual with permanent mobility problems which substantially
impairs his or her ability to ambulate, who has been issued an exemption
entitlement parking permit pursuant to Florida Statute 320.0848.
3. Motor Vehicle: Any vehicle which is self
propelled by any means whatsoever.
4. Public Parking Space: Any parking space
on private property which the owner, lessee or person in control of such
property provides for use by members of the public other than employees of
such owner, lessee or person, including but not limited to parking spaces at
shopping centers, stores, offices, motels, malls, restaurants and marinas.

3 (a) The mininium number of such parking
4 spaces shall be provided as set forth in Florida Statute 316.1955 and
Chapter 18 of the City Code.
B. Prohibitions.
8 It is unlawful for any person to stop, stand,
or park a vehicle within a specially designated and marked parking space pro-

vided in accordance with this Ordinance, unless such vehicle displays a parking
10
permit issued pursuant to Section 320.9848, Florida Statutes, and such

vehicle is transporting a person eligible for the parking permit, 'Whenever 9,

33 law enforcement officer or a parking enforcement specialist finds 4 vehicle in
14 violation of this subsection, that officer may;
15 1. Charge the operator or other person in
16 charge of having the use of the vehicle in violation of this Ordinance
7 punishable as provided herein. However, any person who is chauffeuring a
disabled person shall be allowed without need for an identification parking
permit, momentary parking in any such parking space, for the purpose of loading
or unloading such disabled person. No penalty shall be imposed upon the driver

C. Penalty.

24 1. Any person issued a citation for violating
25 the provisions of this section shall be subject to a fine of $50.00 for each
26 such citation. Any person cited under this provision shall be entitled to the
27 appeal provisions of Section 15--3.2."

29 SECTION 2: That specific authority is hereby granted to codify
this Ordinance.

SECTION 3: That Section 18-8 of the City Code is hereby

repealed and all other Ordinances or parts of Ordinances in conflict herewith
4
are hereby repealed to the extent of such conflict.

SECTION 4: That should any section or provision of this
Ordinance or any portion thereof, or any paragraph, sentence or word be de-
clared by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or any part hereof,
other than the part declared to be invalid.
SECTION 5: That this Ordinance shall become effective
immediately upon its final passage.
