HomeMy WebLinkAboutCity of Tamarac Ordinance O-1983-0371 2 �J 4 5 i 6 7 8 9 10 11 12 13 14 15 16 18 19 20 21 22 23 24 25 26 27 28 29 0 31 32 33 34 35 Introduced by: Am TEmp. # 1054 Revised 9/14/83 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-73 y.-3i AN ORDINANCE AMENDING SUBSECTION 23--2(c) OF THE CITY CODE OF ORDINANCES CREATING A PROVISION PROHIBITING THE PLACEMENT OF CERTAIN OBJECTS WITHIN THE SWALE AREA AND AREAS ADJACENT TO VEHICULAR RIGHTS -OF -WAY; PROVIDING A REPEALED.; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the placement of certain objects within the Swale area or, in the event property is not adjacent to a Swale area, within an area in the vicinity of the vehicular right-of-way on the property, may cause a hazardous condition, and WHEREAS, the City Council deems it in the best interests of the City to prohibit the placement of certain materials and objects within those areas, NOW, ARE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY SECTION 1: That Section 23-2(c) of the City Code is hereby Amended as follows: "(c) Prohibited Placements. The placement and maintenance of shrubbery, sprinkler systems, mailboxes, signs, tree trimmings, refuse, and all other articles or materials within the public right-of-way is prohibited. Furthermore. the placement and maintenance of anv concrete blocks. coral rock ramid-shaped cement curb stones, or any other sharp edged or pointed organic or non -organic or poisonous material which could cause a road or traffic hazard, or injury to pedestrians, on the Swale area adjacent to the public right--of-way within the ten (10) foot area measured from the edge of the laved surface of the vehicular right-of-way is also 2rohibited." SECTION 2: That specific authority is hereby granted to codify this Ordinance. SECTION 4: That if any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or un- constitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. SECTION 5: This Ordinance shall become effective immediately upon its final passage. PASSED FIRST READING this � 2— day of 1983.
