CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-83-
AN ORDINANCE VACATING A 20-FOOT UTILITY
AND CANAL MAINTENANCE EASEMENT IN LAND
SECTION 4, TOWNSHIP 49 SOUTH, RANGE 41
EAST, WITHIN THE WOODMONT MAINTENANCE
AREA; PROVIDING FOR SEVERABILITY OF
INVALID PROVISIONS; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: FINDINGS OF FACT: A determination is hereby made by
the City Council that the utility and canal maintenance easement
described on Exhibit "A" is no longer needed for public purposes and,
accordingly, the easement interest should revert to the private party
(ies) owning the property burdened by the utility and canal mainten-
ance easement to be vacated.
SECTION 2: the utility and canal maintenance easement described in
Exhibit "A", attached hereto and made a part hereof, is hereby
abandoned, vacated and extinguished by the City Council of the City
of Tamarac, Florida, and such utility and canal maintenance easement
shall no longer be deemed property to be used for public purposes on
behalf of the people of the City of Tamarac, Florida.
SECTION 3: Should any section or provision of this Ordinance
or any portion thereof, or any paragraph, sentence or word be declared
by a Court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remainder hereof as a whole or
any part hereof, other than the part declared to be invalid.
SECTION 4: This Ordinance shall become effective upon final
adoption.

PLATTED EASEMENT TO BE VACATED:
FROM the Northwest corner . of Section 4, Township 49 South, Range
41 East, run South 00" 10' 05" East, along the West boundary of
said Section 4 for 3218.04 feet; thence North 890 49' 55" East for
1055.01 feet to the POINT OF BEGINNING; thence North 460 33' 35"
East for 32.01 feet to a point on the boundary between an unnamed
lake and Tract K of LAND SEC. 4 GOLF COURSE PLAT according to the
Plat recorded in Plat Book 88, Page 20 of the Public Records of
Broward County, Florida, and shown on Sheet 10 of 15 thereof;
thence South 07' 53' 35" West, along said boundary for 83.35 feet;
thence South 19° 18' 55" .East, along -said boundary for 50.93 feet;
thence North 68° 42' 47" West for 26.34 feet; thence North 19R 18'
55" West for 38.63 feet.; thence North 07" 53' 35" East for 63.20
feet to the Point of Beginning, containing 0.05420 acres more or
less, and lying in the City of Tamarac, Broward County, Florida,
as shown on attached sketch.
