CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-83-55
AN ORDINANCE N=ING CHAPTER 28, ZONING, SECTION 28-171-
MASTER LIST (OF BUSINESS USES) ENUMERATED BY CLARIFYING
THE SETBACK REQUIREMENTS OF DELICATESSENS, RESTAURANTS AND
DINING ROOMS IN COMMERCIAL CENTERS; PROVIDING A REPEALER;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Council of the City of Tamarac, Florida, adopted Chapter
28 of the City Code, entitled "Zoning"; and
WHEREAS, the City Council wishes to amend a portion of Section 28-171
(Master List of Business Uses) pertaining to the setback requirements of delica-
tessens, restaurants and dining rows located in commercial centers adjacent to
residential property lines.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:

SECTION 1: That Section 28-171 Master List of Business Uses enumerated
is proposed to be amended for the specific uses as follows:
Delicatessen, retail special exception*
Delicatessens can create certain odors,
generate garbage of large quantities
which may attract vermin and insects and
accordingly must be separated by a
sufficient buffer and contain other
standards to protect the health, safety
and welfare of the people. Accordingly,
this use is permitted by special exception
in B-1 and B-2 districts. In adition to
other requirements, the following criteria
must be met:

(1) The structure containing the
establishment shall be at least
100 feet from the nearest
resielenee residential property
line measured in a straight
line from the closest point of the
is-leeated structure containing
the delicatessen (either a free-
standing building or in a cammercial
bay of a business center)to the nearest
residential property line.
(2) There must be prior approval
of the means and method of waste
collection by the city council.
(3) A plan for control, reduction
or elimination of offensive
odors should be submitted with
the application for special
exception to the city.

SECTION 2: All Ordinances or parts of Ordinances in conflict herewith
are hereby repealed to the extent of such conflict.
SECTION 3; Should any section or provision of this Ordinance or any
portion thereof, or any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the validity
of the remainder hereof as whole or any part hereof, other than the part declared
to be invalid.
SECTION 4: Specific authority is hereby granted to codify this
Ordinance.
SECTION 5: This ordinance shall became effective inv ediately upon
its final passage.
