HomeMy WebLinkAboutCity of Tamarac Ordinance O-1984-013Introduced by//tii Temp. #1094 1 1 CITY OF TAMARAC, FLORIDA 1 ORDINANCE NO. x 3 AN ORDINANCE RELATING TO THE ADOPTION OF AN AMENDMENT TO TAMARAC' S LAND USE PLAN ELEMENT 4 OF THE COMPREHENSIVE PLAN REGARDING A PARCEL OF LAND ON TEE SOUTH SIDE OF SOUPEGATE BLVD., 5 PROVIDING FOR ASSEMBLING THE TEXT AND REVISIONS INTO A SINGLE DOCUMENT WITH AUTHORITY TO RENUMBER 6 PAGES AND EDIT SECTIONS AS SHALL BE NECESSARY PROVIDING FOR PUBLIC INSPECTION OF THE INCORPORATED 7 TEXT AND ITS FILING WITH THE APPROPRIATE AUPHORITIES; PROVIDING FOR SEVERABILITY; AMID PROVIDING FOR AN 8 EFFECTIVE'DATE. 9 10 WHEREAS, Section 163.3167(2) of the Florida Statutes requires Tamarac to prepare and adopt a comprehensive plan in the manner set out in �.1 the Local. Government Comprehensive Planning Act of 1975, as amended; and 2 13 WHEREAS, Section 163.3187 of the Florida Statutes permits a 14 municipality to amend its plan when deed necessary by the Local Government 15 through due public notice, and the Broward County Planning Council's rules and .46 regulation permits a municipality to amend its Land Use Plan Element provided x.7 the Plan receives recertification; and 18 19 WHEREAS, Tamarac's Planning Commission acting in its capacity as the Local Planning Authority has prepared an amendment to Tamarac's Land Use 20 Plan Element of its Comprehensive Plan and reviewed the proposed amendment at 21 a public hearing and has recommended adoption to the City Council; and 22 23 WHEREAS, the Broward County Planning Council is required to 24 review said amendment at a public hearing for unconditional recertification 25 subject to final adoption by the City Council of the City of Tamarac; and 26 WHEREAS, the City Council of the City of Tamarac has determined 27 that the proposed amendment to Tamarac's Land Use Element has been prepared 28 in accordance with the Local Government Comprehensive Planning Act of 1975, as 29 amended and "Notice of Regulation of Land Use" has been properly advertised to 30 receive maximum public participation in the comprehensive planning process. 1 32 33 34 00 Temp. #1094 1 2 3 a 5 6 7 8 9 10 I1 .12 13 14 r i3 19 20 21 22 I 23 24 6 27 28 29 30 32 33 34 NOW, THEREFI7RF, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TM1ARAC, FLORIDA: SECTION 1: That the amendment to Tamarac's Land Use Plan dated ( trr -bt -- +insert ed- -aft u-r Dec. 6, 1984 , prepared by the Consultant Planner, regarding a parcel of land approximately four (4) acres in size on the South side of Southgate Boulevard, approximately 1,320 feet East of Northwest•88th Avenue, _attached hereto as Exhibit "A", is hereby adopted as the Amended Land Use Plan Element of the City of Tamarac's Comprehensive Plan in conformance with the Local Government Comprehensive Planning Act of 1975, as amended, Chapter 163, Florida Statutes, subject to recertification by the Broward County Planning Council. SECTION 2: The Consulting Planner shall be responsible for re- assembling the Land Use Plan Element with the adopted amendment into a single document, transmitting a copy of the total document to the Broward County Planning Council, South Florida Regional Planning Council, Department of Community Affairs, Broward County Planning Department, State Library of Florida and making general copies available for distribution to the public. SECTION 3: If any section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by any Court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this Ordinance. SECTION 4: This Ordinance shall become effective immediately upon recertification by the Broward County Planning Council. PASSED FIRST READING this �� � day of 1984.
