ORDINANCE NO. 0- 4
AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES,
PROVIDING FOR THE REZONING OF CERTAIN REAL
PROPERTY FROM A-5 (AGRICULTURAL/EXCAVATION) TO
B2 (PLANNED COMMUNITY BUSINESS) WITH THE EXCEPTION
OF THE WESTERN 288-FEET WHICH IS REZONED,UTILIZING
THE 5% FLEXIBILITY RULE FOR COMMERCIAL DEVELOPMENT
IN RESIDENTIAL LAND USE AREA NOT TO EXCEED 9.09
ACRES; SAID LAND BEING THE SOUTH 300-FEET OF TRACT
13, SECTION 8, TOWNSHIP 49 SOUTH, RANGE 41 EAST,
FORT LAUDERDALE TRUCK FARMS SUBDIVISION, ACCORD-
ING TO THE PLAT AS RECORDED IN PLAT BOOK 4, PAGE 31
OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA
(OTHERWISE IDENTIFIED AS BEING THOSE LANDS ON THE
NORTH SIDE OF PROPOSED COMMERCIAL BOULEVARD AND ON
THE EAST SIDE OF PROPOSED NOB HILL ROAD); PROVIDING
FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT
SUCH CHANGE; PROVIDING FOR SEVERABILITY; AND PRO-
VIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the instruction of the City Council of the
City of Tamarac, Florida, public notice has been given in accordance
with the applicable law of the time and place of public hearing re-
garding the zoning of the property described herein and the said
public hearing has been held in accordance with the notice and the
public has been given an opportunity to be, and has been heard; and
the Council has examined and investigated the request for the zoning
herein and has received the recommendation of the Planning Commission
of the City of Tamarac; and
WHEREAS, public hearing has been held on Petition 9-Z-84 by the
City Council, pursuant to the Charter.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That those lands described in Exhibit "A" attached
hereto and made a part hereof, are hereby rezoned from A-5 to B-2,
with the exception of the western 288-feet which is hereby rezoned
from A-5 to B-3 as shown on Exhibit "B".
SECTION 2: That the Official Zoning Map of the City of Tamarac
shall be changed to reflect in the zoning, said changes to be
initialled by the Mayor and the City Clerk, together with the
effective date of this Ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.

SECTION 4: Should any section or provision of this Ordinance
any portion thereof, or any paragraph, sentence or word be declared
a Court of competent jurisdiction to be invalid, such decision
all not affect the validity of the remainder hereof as a whole or
y part hereof, other than the part declared to be invalid.
SECTION 5: This Ordinance shall become effective immediately
its final passage.
