Ord. #1120 84301317 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0--84- �-`=— AN ORDINANCE VACATING A 5-FOOT UTILITY EASEMENT ALONG THE NORTHERN LINES OF LOT 4, BLOCK 17 OF "THE WOODLANDS SECTION TWO - PHASE ONE" AS RECORDED IN PLAT BOOK 66, PAGE 23 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, EXCEPTING THEREFROM THE EXTRA 15-FEET OF SAID EASEMENT; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: FINDINGS OF FACT: A determination is hereby made by the City Council that the 5-foot utility easement described on Exhibit "A" is no longer needed for public purposes and, accord- ingly, the easement interest should revert to the private party(ies) owning the property burdened by the 5-foot utility easement to be vacated. SECTION 2: The 5-foot utility easement described in Exhibit "A", attached hereto and made a part hereof, is hereby abandoned, vacated and extinguished by the City Council of the City of Tamarac, Florida, and such portion of utility easement shall no longer be deemed property to be used for public purposes on behalf of the people of the City of Tamarac, Florida. .,SECTION 3: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
