ORDINANCE NO. y�
AN ORDINANCE CREATING CHAPTER 3A OF THE
TAMARAC CITY CODE: EMERGENCY MEDICAL TRANS-
PORTATION SERVICE; PROVIDING FOR INTENTIONS
AND OBJECTIVES OF THE SERVICE; PROVIDING FOR
DEFINITIONS; PROVIDING FOR EQUIPMENT SPECIFI-
CATIONS; PROVIDING FOR PERSONNEL SPECIFICA-
TIONS; PROVIDING FOR FEE SCHEDULES AND STAN-
DARDS; PROVIDING FOR SEVERABILITY; PROVIDING
FOR CODIFICATION; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Council in Resolution 83-289 endorsed
the concept of a City operated ambulance service; and
WHEREAS, the City has purchased two ambulances for the
implementation of its ambulance service.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
=ION 1: That Chapter 3A of the Tamarac City Code is
hereby created to provide as follows:
"Chapter 3A
Ambulance Service
3A-1 Intentions and Objectives
a) It is the intention and purpose of this chapter to
establish a City operated Emergency Ambulance
Transportation Service (hereinafter known as the
Service). To this end maximum use of dual position
Fire Fighters/Emergency Medical Technicians using
certified ambulances of the Tamarac Fire Department
will be used to provide an efficient service to the

residents and visitors of the City of Tamarac while
complying with all applicable State and County laws.
b) The Fire Department of the City of Tamarac is auth-
orized and directed to develop this Service to
respond to all medical emergencies requiring Basic
Life Support (BLS) transportation to a location as
directed by a Paramedic called to the point of
emergency or in the absence of a Paramedic by the
advice of a Broward County Emergency Medical
Services dispatcher.
c) The Service shall be restricted to providing Basic
Life Support Service to persons located within the
boundaries of the City of Tamarac, thus the Service
shall not provide Advanced Life Support (ALS)
service nor non -emergency medical transportation
service.
3A-2 Definitions
a) Advanced Life Support (ALS): As used herein means
treatment of life threatening medical emergencies
through the use of techniques such as endotracheal
intubation, the administration of drugs, intravenous
fluids, telemetry, cardiac monitoring, and cardiac
defibrillation, by a qualified person. (Fla. Stat.
401.23)
b) Ambulance: As used herein means an EMS Transport
Vehicle.
c) Ambulance Drivers: As used herein means a Tamarac
fire-fighter who meets the minimum basic
requirements of Fla. Stat. 401.281, with the
exception of Fla. Stat. 401,.281 (G), and who is also

qualified as a state certified emergency medical
technician.
d) Area of Service for Response: As used herein means
the geographical boundaries of the City of Tamarac.
e) Basic Life Support (BLS): As used herein means
treatment of life --threatening medical emergencies by
a qualified person through the use of techniques
such as patient assessment, basic cardiopulmonary
resuscitation, splinting, obstetrical assistance,
bandaging, administration of oxygen, application of
medical antishock trousers, and other techniques
described in the Emergency Medical Technician Basic
Training Course Curriculum of the United States
Department of Transportation. "Basic Life Support"
also includes esophageal intubation if the emergency
medical technician performing the intubation has
been trained in the skill of esophageal intubation
and is performing the intubation under the medical
direction of a licensed physician. The monitoring
and maintenance of an intravenous fluid may be
performed by a Certified Emergency Medical
Technician if such person is trained in these
skills. (Fla. Stat. 401.23.)
f) Certificate: As used herein means a certificate of
convenience and necessity issued pursuant to Chapter
3 1/2 of the Broward County Administrative Code and
Chapter 401 of the Florida State Statutes.
g) Closest Appropriate Medical Facility: As used
herein means the destination of the EMS transporta-
tion as directed by a Paramedic or in the absence of
a Paramedic by the advice of a Broward County Emer-
gency Medical Services dispatcher.

Emergency Call: The term "emergency call" as used

herein means the response of an emergency medical
2
service (EMS) provider to the scene of a reported
3
medical emergency under conditions that warrant
4
travel with flashing lights and sirens operating
5
pursuant to the request of the emergency
6
communications center, or a public safety agency.

EMS Transport Vehicle: As used herein means a
9
vehicle that is designed, constructed,

reconstructed, maintained, equipped or operated for,
1
and is used for, or intended to be used for, land
2
transportation of sick or injured persons who are in
3
the need of emergency medical attention during
4
transport and who must be transported on a stretcher
5
and shall conform to requirements of Fla. Stat.
6
401.26.

j)
Emergency Medical Technician (EMT): As used herein,
9
means any person who is trained in basic life
0
support and who is certified to perform such
1
procedures in emergency situations in accordance
2
with Florida Law. (Fla. Admin. Code Sec. 1OD-
3
66.56)

k)
Medical Direction: As used herein means direct
6
supervision of a state certified paramedic on the
7
scene or by communication with the Broward County
8
Emergency Communications System --or by a physician
9
through two-way voice communications or when such

voice communications is unavailable, through
1
established standing orders, pursuant to rules of
2
the Florida State Department of Health and
3
Rehabilitative Services. (Fla. Stat. 401.23 (15))

1) Non -Emergency Medical, Transportation Service: As
used herein means any privately or publicly owned
service employing a land vehicle that is designed,
constructed, re -constructed, maintained, equipped or
operated for, and is used for, or intended to be
used for land transportation of persons who are
confined to wheelchairs or stretchers and whose
condition is such that these persons do not need,
nor are likely to need, immediate medical attention
during transportation. (Fla. Stat. 401.23)
m) Paramedic: As used herein means any person who
possesses a valid paramedic certificate in
accordance with Florida law.
n) Permit: As used herein means any authorization
issued pursuant to Chapter 301 of the Florida State
Statutes for a vehicle to be operated as a transport
vehicle providing basic or advanced life support.
(Fla. Stat. 401.23)
o) Physician: As used herein means a practitioner who
is licensed under the provisions of Chapters 458 or
459 of the Florida State Statutes. (Fla. Stat.
401.23)
p) Service: As used herein means the Emergency
Ambulance Transportation service operated by the
City of Tamarac.
3A-3 Equipment
a) The Service shall operate at least two (2) fully
equipped ambulances. At least one ambulance shall
at all times be on active duty in each Tamarac Fire
Station. In addition, a maintenance reserve ambu-
lance shall be available for use by the service when

one of the Service's regular ambulances is out of

service.
b) The Service shall at all times maintain its ambu-
lances in good working condition and equip them to
conform to all applicable requirements of law.
3A-4 Personnel
a) The Service ambulances shall be staffed solely by
members of the Tamarac Fire Department who shall
concurrently be qualified as emergency medical
technicians in conformance with all applicable
requirements of law.
b) The Tamarac Fire Department shall within a reason-
able time develop an instructional guide for main-
tenance, use and operations of the Service ambu-
lances. All Service personnel shall be familiar
with this guide and any other directives promulgated
by the Fire Department.
3A-5 Fees
a) The Service shall charge a base fee of seventy-five
dollars ($75) for each ambulance transportation
provided from the point of emergency to the closest
appropriate medical facility. If an ambulance
responds to a reported emergency and no person is
transported, then no fee will be charged for the
response.
b) The Service shall accept any insurance assignment or
medicare assignment, as full or part payment of the
above fee, which conforms.to applicable law.

c) The Service shall have the right to hire a private
contractor approved by City Council to administer
the billing process or to assign its accounts
receivable to any organization licensed as a
collection agency.
d) Non-residents who require emergency medical service
while in the City of Tamarac shall be charged at the
same rate as service for residents.
e) In the event of the non -availability of the Service,
all eligible persons who utilize a private emergency
medical service are liable to that private service
for the fees charged by such private service.
f) No eligible person shall be denied service or treat-
ment by the Service because of inability to pay.
g) All fees collected shall be shown as revenue in the
General Fund Budget."
Should any section or provision of this
ordinance or any portion hereof or any paragraph, sentence or
word be declared by a Court of competent jurisdiction to be
invalid such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof other than the
part declared to be invalid.

codify this ordinance.
