ORDINANCE NO. 0-84-_1:5j/?
AN ORDINANCE CONTINUING A MORATORIUM ON DEVELOPMENTS
DESIGNATED AS INDUSTRIAL ON TAMARAC'S LAND USE PLAN
MAP LOCATED IN LAND SECTION 7, T49S, R41E FOR A
SPECIFIC PERIOD OF TIME UNTIL THE COMPLETION OF THE
INDUSTRIAL PLANNING STUDY; ESTABLISHING AN EXPIRATION
DATE; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS;
PROVIDING REPEALER: AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council for the City of Tamarac exercised its authority
as provided in F.S. 163 (Part Two) and has adopted a Comprehensive Land Use Plan in
accordance with the requirements and procedures contained in said law; and
WHEREAS, one of the goals included in Tamarac's Comprehensive Land Use
Element speaks to the need for establishing "Industrial and Office Parks, as
balances to the Residential component", and
WHEREAS, areas for future industrial development are primarily designated
on Tamarac's Future Land Use Plan Map in Section 7, T49S, RGlE, Exhibit A, herein-
after referred to as "Land Section 7", being more specifically located south of
McNab Road, north of Commercial Boulevard, west of Nob Mill Road and east of the
conservation area, and
WHEREAS, "Land Section 7" is not currently planned for capital improvements,
such as, public water, sewer, drainage and other public infra -structures; and
WHEREAS, the City of Tamarac has been diligently studying the consequences
lof uncontrolled industrial development since the preparation of its first land use

plan, and
WHEREAS, there remains bona fide planning issues and problems that may and

do negatively affect the quality of life and well-being of the citizens of Tamarac
27
including such matters as delivery of essential public services and utilities,
28
traffic congestion, controlling pollution, drainage and waste disposal; and
29
WHEREAS, petitions of concern about uncontrolled industrial development
30
have been received by the Planning Commission (Local Planning Agency) and the City
.Council from concerned residents; and

WHEREAS, the City Council of the City of Tamarac declares its intent to
exercise its planning and management responsibilities by assigning to its Planning
Commission (L.P.A.) the initiation of a study to determine a rational basis for
managing future industrial developments in Land Section 7 including such items as
essential public services, amount of land required to meet the needs of the
community, proper subdivision regulations, zoning regulations, capital improvement
program and alternative methods for constructing the basic public infrastructures.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That there is hereby established a moratorium on the issuance
of any further development permits for lands designated as industrial on Tamarac's
Land Use Plan Map located in "Land Section 7" including but not limited to:
rezoning requests, platting, site plan approval, and special exceptions. For the
purpose of this ordinance, industrial, projects shall be defines as those primary
uses included on page 22 of Tamarac's Land Use Plan, Permitted Uses in Industrial
Areas (Items 1-3).
SECTION 2: That due to the possible need for recertification of its
Comprehensive Land Use Plan by the Broward County Planning Council, this moratorium
shall continue until April 10, 1985, when it is anticipated that the Comprehensive
Land Use Plan will be properly amended with regard to the provisions for industrial
development in "Land Section 7" as a result of the Planning Commission's study
underway by Staff and professional planning and engineering consultants.
SECTION 3: Should any section or provision of this ordinance or any portion
thereof, or any paragraph, sentence or word be declared by a Court of competent
jurisdiction to be invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the part declared to
be invalid.
SECTION 4: All ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION 5: This ordinance shall become effective immediately upon its
adoption.
