HomeMy WebLinkAboutCity of Tamarac Ordinance O-1985-0031 Introduced by: Temp. #21-k - 2 CITY OF TAMARAC, FLORIDA 3 ORDINANCE 4 AN ORDINANCE CREATING SECTION 15-7 OF THE 5 TAMARAC CITY CODE BY AMENDING ORDINANCE 77-23 PROVIDING FOR THE PLACEMENT OF CONSTRUCTION 6 TRAILERS ON BUILDING SITES; PROVIDING FOR REPEAL OF OBSOLETE ORDINANCES; PROVIDING FOR 7 CODIFICATION; PROVIDING FOR SEVERABILITY FOR INVALID PROVISIONS; AND PROVIDING AN EFFEC- 9 WHEREAS, it is desirable to incorporate Ord. 77-23 into 10 the City Code and repeal obsolete related ordinances, 11 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF 12 THE CITY OF TAMARAC, FLORIDA: 13 B-BMON _ 1: That Ordinance. 77--23 is hereby Codified as 14 section 15-7 of the City Code and amended to provide as 15 follows: 16 "Sec. 15-7. Parking and storage of construction office 17 trailers. 16 A, <fe3 '-ham -wh�r-4--> Where a builder holding a valid, 19 active Engineering and/or Building Permit desires to place a 20 mobile vehicle or trailer upon the premises as a temporary 21 construction office, he may apply for a six months' permit 22 for such vehicle, upon payment of a fee of $50.00 (fifty 23 .dollars) and certification of the safety thereof by the Chief 24 Building Official, and providing that such vehicle is 25 licensed by the State of Florida. Such vehicle shall be kept 26 on wheels and shall be promptly removed upon completion of 27 building operations, or upon any cessation thereof for a 28 period of more than 30 days. The Chief Building Official may 29 enter such orders as he deems advisable with respect to the 30 anchoring of the vehicle due to wind or storm conditions, and with respect to sanitary facilities. Any person aggrieved by such order may appeal the same to the Board of Adjustment. 33 B, <Tha-L---why-r-e> Where a builder demonstrates a need to 34 place a mobile vehicle or trailer upon the premises as a temporary construction office prior to the application and issuance of an active engineering and/or building permit. he () U -1- I 4� 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 i 32 33 34 Temp. #1162 may apply to the Chief Building Official for a waiver of the provisions of this ordinance, requiring as a prerequisite the approval of a preliminary site plan. In no event shall such permit, if granted, be valid for a period to exceed ninety days and upon payment of a fee of $50.00 (fifty dol- lars) and certification of the safety thereof by the Chief Building Official and providing that such vehicle is licensed by the State of Florida. At the end of the ninety day. period no extention or renewal of this temporary permit may be granted. At the end of this period the mobile vehicle shall either be moved or provisions of Section 1 of this ordinance shall be met." SEC-T,Q 1-2: Ordinances 75--39, 72-16, and 70-8, being obsolete, are hereby repealed. _5B9 R_ : Specific authority is hereby granted to codify this ordinance. U_QT_QN_4: Should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. 59=N _a-- This ordinance shall become effective immediately upon its passage.
