Ord. #1114 Rev. 1/31/85 1 Rev. 2/6/85 Rev. 3/13/85 2 CITY OF TAMARAC, FLORIDA 3 ORDINANCE NO. 0-85- 4 5 AN ORDINANCE AMENDING SECTIONS 24-10, 24-30, 24-32, 24-33 AND 24-34 OF THE TAMARAC CITY 6 CODE, RELATING TO THE CONSTRUCTION OF CANAL AND LAKE SIDE SLOPES; PROVIDING FOR 7 SEVERABILITY; PROVIDING FOR CODIFICATION; AND 9 WHEREAS, the City Engineer has confronted continuing 10 construction problems with the canal section provided in the .1 Code; and 12 WHEREAS, the City Engineer recommends the proposed 13 modifications to the requirements; and 14 WHEREAS, the revised illustration to be placed in the is code incorporates the following canal bank slope design 16 changes; eliminating the four foot berm; and revising the 17 above ground slope. �_8 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF «9 THE CITY OF TAMARAC, FLORIDA. 20 SECTION --I: That Section 24-10(a) of the Tamarac City 21 Code is hereby amended to provide as follows: 22 "Sec. 24-10. As -built record drawings. 23 (a) Preparation. The developer shall engage the 24 services of a registered engineer or land surveyor 25 to prepare record drawings of the improvements, 26 which shall clearly include any deviations from the 27 approved engineering drawings. <Two--(-�--pi4� -co-f- 28 29 =. 0 ins_ � signed, < trd-> sealed ►��� g5� by the 31 responsible professional, together with a certifi- 32 cate in which said professional, certifies that the 33 completed improvements comply with all of the 34 applicable city ordinances, shall be submitted to the city engineer. No <gatLtr-e> canal shall have a width between faces of seawall of less than eight-T-00) feet. Where no seawall is required, the future canal shall have a minimum width of eighty (80) feet as measured at the design water elevation. The eleva- tion of the bottom at the center of t1le canal or lake shall be a minimum of twelve (12) feet below the design water elevation as indicated in Sec. 24-32. The side slopes of the canal or lake shall be consistent with the natural angle of repose of the subsurface material. Construction schedule for canal seawalls or slopes. In residential areas, no permits for lots adjacent to lakes or canals, except for five (5) model units, and in nonresidential areas, no permits or buildings, shall be issued before canal seawalls are constructed or canal slopes below watgare excavated as per the illustration shown in section 24-32. Prior to the issuance of a certificate of occupancy, the canal bank slope area shall be inspected and approved in writing, with a copy of approval. maintained in the city's records. Upon receipt of approval of the engineering department inspector, the sod shall be installed without delay. If not installed within twenty-four (24) hours, a reinspection shall be required." Developments which 10 have received final site plan approval before March 13, 1985, may elect to use the standards included in this amendment e2 rather that the provisions of the City Code regarding canal 13 bank slopes that was in effect at the time of site plan 14 approval, provided that an amended site plan is submitted in 15 accordance with Chapter 7 of this Code, and approved by City 16 Council. 17 "8 PASSED FIRST READING this 27th day of February , 1985.
