AN ORDINANCE AMENDING SECTION 9-39 OF THE

TAMARAC CITY CODE, CLARIFYING THE EMERGENCY

PURCHASES EXCEPTION TO THE BID REQUIREMENTS
AS AUTHORIZED BY SECTION 7.12 OF THE TAMARAC
CHARTER; PROVIDING FOR CODIFICATION; PROVID-

ING FOR SEVERABILITY; AND PROVIDING AN EFFEC--
TIME DATE.

WHEREAS, Section 7.12 of the Tamarac City Charter
empowers the City Council to establish guidelines and

procedures for emergency purchases; and

WHEREAS, it is desirable that the city manager be em-
powered to make certain emergency purchases in order to
2
maintain the integrity of the City's large scale operations.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:

=TION _ l : That Section 9--39 of the Tamarac City Code

is amended to provide as follows:

"Sec. 9-39 Exception to bid requirements.

Only the following situations are exempted from the
competitive bid requirements of this article:
(1) (a) Emergency purchases. "Emergency" as used in

which may require immediate action for the

protection of the safety, health and welfare
of the community or any segment thereof.

codify this Ordinance.
_2 TIOR-. 3: Should any section or provision of this
Ordinance or any portion thereof, or any paragraph, sentence
or word be declared by a Court of competent jurisdiction to
be invalid, such decision shall not affect the validity of
the remainder hereof as whole or any part hereof, other than
the part declared to be invalid.
This Ordinance shall become effective
immediately upon its final passage.
