AN ORDINANCE AMENDING SECTION 28-1 OF THE
TAMARAC CITY CODE BY THE ADDITION OF THE

FLORIDA STATUTE DEFINITIONS OF "SPECIAL
EXCEPTION" AND "VARIANCE"; AMENDING

SECTION 28-194(d) OF THE TAMARAC CITY CODE
REGARDING FENCES, WALLS AND HEDGES BY SUBSTI-

TUTING "VARIANCE" FOR "SPECIAL EXCEPTION";
PROVIDING FOR SEVERABILITY OF INVALID PROVI-

SIONS; PROVIDING FOR CODIFICATION; AND PRO-

WHEREAS, the City Council desires to include the Florida
11
Statute definition of "special exception" and "variance" in
12
Section 28-1 of the Tamarac City Code and to conform Section
13
8-194(d) of the Tamarac City Code with those definitions by
14
substituting "variance" for "special exception" where appro-
15
priate;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
17
THE CITY OF TAMARAC, FLORIDA:

5ECTLON--2: That Tamarac City Code Sec. 28-194 "Car

shelters, etc; projections into required yards; setback
13
exception; fences, walls and hedges", (d), is hereby amended
14
to provide as follows:

"(d) Fences, walls and hedges, not exceeding six (6)
16
feet in height as measured from the natural contour of the
17
premises, may be maintained along any side or rear lot line
18
19
or elsewhere within the side yard setback area between the
required street front setback and the rear building line.
20
The board of adjustment, in a proper case, may grant a
21

height of any fence, wall or hedge, where circumstances show
23
that such is desired by the adjoining
24
property owners or will promote the public safety and general
25
welfare."

Should any section or provision of this
27
ordinance or any portion hereof or any paragraph, sentence or
28
word be declared by a Court of competent jurisdiction to be
29
invalid, such decision shall. not affect the validity of the
30
remainder.hereof as a whole or any part hereof other than the
part declared to be invalid.
