4 AN ORDINANCE REGARDING METHOD OF PAYMENT AND
ENFORCEMENT OF WATER AND SEWER IMPACT FEES;
AMENDING SECTION 27--51 OF THE TAMARAC CITY
CODE, DELETING ALL REFERENCES TO DEFERRED
PAYMENTS AND FINANCING OF WATER AND SEWER
CONTRIBUTION CHARGES; AMENDING
SECTION 27-52 OF THE TAMARAC CITY CODE,
8 DELETING SOME REFERENCES TO DEFERRED PAYMENTS
FOR WATER AND SEWER GUARANTEED REVENUES;
9 PROVIDING FOR SEVERABILITY OF INVALID
PROVISIONS; PROVIDING FOR CODIFICATION; AND

12 WHEREAS, the present form of developer's agreement makes
13 no Provision for deferred payments or financing of water and
14 sewer contribution charges; and
15 WHEREAS, the City Council desires to conform the appli-
16 cable Code sections to the developer's agreement.
17 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
18 THE CITY OF TAMARAC, FLORIDA:
19 SECT1,0N 1: That Section 27-51 of the Tamarac City Code
20 is hereby amended to provide as follows:
21 "Sec. 27-51. Contribution charges.
22 (a) (Same.)
23 (b) The city requires, at the time of site plan ap-
24 proval, an executed developers agreement containing
25 a provision setting forth a schedule for payment of
all water and sewer, or either as applicable,
26
contribution charges. Contribution charges for
27

29 payable no later than the time of final site plan

cost of a portion of capital improvements. Contribution
charges may not be used to pay for replacement of existing
facilities, the cost of which would necessarily have had to
be borne by existing customers of the system whether or not
the party paying the contribution charge had become a part of
the system. The moneys are not to be treated as revenue to
the utility.

That Section 27-52 of the Tamarac City Code
is hereby amended to provide as follows:
"Sec. 27-52. Guaranteed revenues.
IAA For the purpose of defraying the cost of main-
taining reserve capacity in the water and sewer
treatment plants, a developer shall pay monthly for
guaranteed revenues in an amount equal to the service
availability charge for water and sewer service for each
equivalent residential connection in accordance with the
rate schedule of the city as the same may be amended

running with the land and shall be a
condition precedent to further service and
binding upon the developer, its successors
and assigns or subsequent owners holding by
or through the developer."
SJUT-I,QUT 1: Should any section or provision of this
Ordinance or any portion thereof, or any paragraph, sentence
or word be declared by a Court of competent jurisdiction to
be invalid, such decision shall not affect the validity of
the remainder hereof as whole or any part hereof, other than
the part declared to be invalid.
