AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES, PROVIDING FOR TFE REZONING OF CERTAIN REAL PROPERTY FROM R-3 (LOW DENSITY MULTIPLE DWELLING) TO B-2 (PLANNED BUSINESS) AND S-1 (OPEN SPACE/RECREATIONAL); LANDS IDENTIFIED AS PORTIONS OF TRACT 5, OF FORT LAUDERDALE TRUCK FARMS SUBDIVISION, LAND SECTION 10, TOWNSHIP 49 SOUTH, RANGE 41 EAST, AS RECORDED IN PLAT BOOK 4, PAGE 31 OF THE PUBLIC RECORDS OF BROWARD COUNTY (OTHERWISE IDENTIFIED AS BEING THOSE LANDS AT THE SOUTHEAST CORNER OF UNIVERSITY DRIVE AND NW 64 STREET); PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of he City of Tamarac, Florida, public notice has been given in accordance ith the applicable law of the time and place of public hearing regardin he zoning of theproperty described herein and the said public hearing s been held in accordance with the notice and the public has been iven an opportunity to be, and has been heard; and the Council has xamined and investigated the request for the zoning herein and has eceived the recommendation of the Planning Commission of the City of 20 amarac; and 21 WHEREAS, public hearing has been held on Petition 27-Z-84 by 22 he City Council, pursuant to the Charter. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 1AMARAC, FLORIDA: 24 SECTION 1: That those lands described in Exhibit "A" attached 25 26 ereto and made a part hereof are hereby rezoned from R-3 to B-2 and S-1. SECTION 2: That the Official Zoning Map of the City of Tamarac 27 hall be changed to reflect in the zoning, said changes to be initialed 28 y the Mayor and the City Clerk, together with the effective date of 29 his Ordinance. 30 SECTION 3: All ordinances or parts of ordinances in conflict 31 erewith are hereby repealed to the extent of such conflict. 32 33 ,J .Y 1� 1 SECTION 4: Should any section or provision of this Ordinance 2 r any portion thereof, or any paragraph, sentence or word be declared 3 y a Court of competent jurisdiction to be invalid, such decision 4 3hall not affect the validity of the remainder hereof as a whole or 5 Iny part hereof, other than the part declared to be invalid. 6 SECTION 5: This Ordinance shall become effective immediately 1 7 Ppon its final passage.
