CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-85-g&
AN ORDINANCE VACATING CERTAIN UTILITY EASEMENTS
LOCATED WITHIN A PORTION OF PARCELS 2 AND 3,
CYPRESS AT WOODMONT III, ACCORDING TO THE PLAT
THEREOF, AS RECORDED IN PLAT BOOK 107, PAGE 4,
OF THE PUBLIC RECORDS OF'BROWARD COUNTY, FLORIDA,
FOR THE PROPOSED JASMINE PROJECT: PETITION #1-V-85;
PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: FINDING OF FACT: A determination is hereby made
by the City Council that certain utility easements described in
Exhibit "A" are no longer needed for public purposes and, accord-
ingly, the easement interest should revert to the private party(ies)
owning the property burdened by the various easements to be vacated.
SECTION 2: The certain utility easements described in
Exhibit "A", attached hereto and made a part hereof, are hereby
abandoned, vacated and extinguished by the City Council of the City
of Tamarac, Florida, and such portions of utility easements shall no
longer be deemed property to be used for public purposes on behalf
of the people of the City of Tamarac, Florida.
SECTION 3: Should any section or provision of this Ordinance
or any portion thereof, or any paragraph, sentence or word be
declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole or any part hereof, other than the part declared to be invalid.
SECTION 4: This Ordinance shall become effective upon final
adoption.
