Rev. 9/11/85 f __ ection SECTIQ,N-2.: That Section 15-4 of the City Code is hereby amended to provide as follows: "Sec. 15-4. Parking restrictions. (a) Public Rights -of -Way. (1) There shall be no vehicular parking in the paved portions of the dedicated public right- of-way areas within the limits of the city during the hours between 2:00 a.m. and 6:00 a.m., except those vehicles commonly desig- nated as emergency vehicles. This prohibition shall apply seven (7) days a week. (2) The parking of motor vehicles anywhere on the Woodlands Boulevard right-of-way at any time of the day or night is hereby prohibited. for_a�y Person tend&d rgI <flnr-)-> Enforcement. (1) Violation. Any unauthorized person parking in conflict with section 15-4(a) and-_.��1 or 5-5 is subject to the penalty set forth in section <3-5-444b-444-> 15-4(cl-133) . (2) Ticketing procedure. Vehicles parked in violation of this section shall be ticketed by the police department, said ticket to be affixed to the windshield of the offending vehicle. The owner or operator of said ve- hicle shall appear at the police department within seventy-two (72) hours and pay a penal- ty in accordance with the schedule established in paragraph (3) of this subsection. (3) Penalty. A charge of five dollars ($5.00) shall be assessed for the first violation of this section. Any repeat violation by the same owner, however, shall be assessed as follows: A. Second violation ...................$10.00 B. Third violation .................... 15.00 C. Fourth violation.... ............ 20.00 D. Fifth violation and each violation thereafter .............. 25.00 (4) Refusal to accept and sign citation or notice to appear. Any person who willfully refuses to accept and sign a citation or notice to appear issued pursuant to this section shall be guilty of a separate violation, and that person may be arrested by any law enforcement officer of the city. (5) Failure or refusal to pay penalty. A fine of not more than five hundred dollars ($500.00) shall be assessed against any person who shall refuse or fail to pay a penalty assessed for viola- tion of this section." EEQTI.QNLA : That all ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. S=JQV__5_: That should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid.
