No. 1212 1 2 3 4 5 6 7 8 9 10 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0- 85-,5o AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES, PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY FROM R-4A (PLANNED APARTMENTS) TO S-1 (OPEN SPACE/RECREATIONAL); LANDS DESCRIBED AS A PORTION OF PARCEL "C" OF THE PLAT OF "TAMARAC FAIRWAYS" AS RECORDED IN PLAT BOOK 81, PAGE 36 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA (OTHERWISE DESCRIBED AS THE PROPOSED SITE FOR THE CABANA AND POOL AREA FOR BOARDWALK APARTMENTS ON THE NORTH SIDE OF NW 61 STREET BETWEEN NW 84 TERRACE AND NW 88 AVENUE); PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. 12 WHEREAS, pursuant to the instruction of the City Council of 13 he City of Tamarac, Florida, public notice has been given in accordancE 14 ith the applicable law of the time and place of public hearing regardir 15 he zoning of the -property described herein and the said public hearing 16 as been held in accordance with the notice and the public has been 17 iven an opportunity to be, and has been heard; and the Council has 18 xamined and investigated the request for the zoning herein and has 19 eceived the recommendation of the Planning Commission of the City of 20]he amarac; and 21 WHEREAS, public hearing has been held on Petition #18-Z-85 by 22 City Council, pursuant to the Charter. 231 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF 24 qAMARAC, FLORIDA: 25 SECTION 1: That those lands described in Exhibit "A" attached 26 ereto and made a part hereof are hereby rezoned from R-4A to S-1. 27 SECTION 2: That the Official zoning Map of the City of Tamarac 28 all be changed to reflect in the zoning, said changes to be initialed 29hy the Mayor and the City Clerk, together with the effective date of 30is Ordinance. 31 SECTION 3: All ordinances or parts of ordinances in conflict 32 rewith are hereby repealed to the extent of such conflict. 33 34 I 1 2 3 4 5 SECTION 4: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision ,shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 5: This Ordinance shall become effective immediately upon its final passage.
