CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-85--!�3
AN ORDINANCE CREATING ARTICLE IV OF CHAPTER 11
I OF THE TAMARAC CITY CODE; PROVIDING FOR A
RESIDENTIAL GARBAGE COLLECTION AND DISPOSAL
6 FEE; PROVIDING FOR CITY COUNCIL DETERMINATION
OF THE PERCENTAGE OF COST PASS THROUGH TO THE
7 CUSTOMER; PROVIDING FOR BILLING THROUGH -THE
UTILITY BILL; PROVIDING FOR CODIFICATION;
PROVIDING FOR SEVERABILITY OF INVALID
PROVISIONS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the budget for fiscal year 1985-86 provides
11 that part of the City's cost for residential garbage
collection under its contract for solid waste collection and
12 disposal shall be passed through to the recipients of such
service.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
14 THE CITY OF TAMARAC, FLORIDA:
15 SECTION_1: That Article IV of Chapter 11 of the Tamarac
City Code is hereby created to provide as follows:

"ARTICLE IV. RESIDENTIAL GARBAGE COLLECTION AND

11-30. Fee - Established
There

Sec.
11-31. Fee - Applicability

The
garbage collection and disposal fee shall be
applicable
to all residential units offered curbside service

and all
condominium units offered dumpster service by
contract
between the City and a garbage collection

Sec.
11-32. Rate

The
City Council shall, by resolution, establish the
rate to be
paid for garbage collection and disposal service
27
as a percentage
of the actual cost incurred by the City under
its residential garbage collection and disposal contract.

Sec.
11-33. Billing

(a)
Billing of the garbage collection and disposal fee

will be accomplished by including said fee as a
separate line item on the utility bills of those
utility customers to whom said fee applies.
(b) Payment of the garbage collection and disposal fee
shall be due and payable simultaneously with all
other charges itemized on the utility bill.
44 Non-payment of said fee shall be grounds for
discontinuance of utility service in accordance
with the procedures established in Chapter 27
(Water and Sewers) of this Code. The garbage
collection fee shall continue to be assessed re-
gardless of any temporary discontinuation of
utility service pursuant to Chapter 27 of this
Code.

(c) The garbage collection and disposal fee may be
prepaid for a number of months. In the event the
fee is increased, the customer shall be liable for
the increase in excess of the prepaid amountr
calculated from the effective date of the increase.
(d) All other applicable provisions of Chapter 27 of
this Code concerning utility billing shall apply to
the billing of the garbage collection and disposal
fee."
Specific authority is hereby granted to
codify this Ordinance.
SECTION 3: Should any section or provision of this
Ordinance or any portion thereof, or any paragraph, sentence
or word be declared by a Court of competent jurisdiction to
be invalid, such decision shall not affect the validity of
the remainder hereof as whole or any part hereof, other than
the part declared to be invalid.
SEC_T1QN__A: This Ordinance shall become effective
immediately upon its final passage.
