ORDINANCE NO. 0-85-��
AN ORDINANCE VACATING A PORTION OF A 106 FOOT RIGHT -
OF --WAY (KNOWN AS N.W. 57TH STREET) LYING IN SECTION
11, TOWNSHIP 49 SOUTH, RANGE 41 EAST, AS RECORDED IN
OFFICIAL RECORDS IN BOOK 3918, PAGE 856, OF THE
PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA; PETITION
#3-V-85; PROVIDING FOR SEVERABILITY OF INVALID PRO-
VISIONS; -AND -PROVIDING
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 3 FINDING OF FACTa A determination is hereby
made by the City Council that the portion of a 106-foot Right -of -
Way (known as N.W. 57th Street) described in Exhibit "A" is no
longer needed for public purposes and, accordingly, the Right -of -
Way interest should revert to the private party(ies) owning the
property burdened by the Right -of -Way to be vacated.
SECTION_2,.L That portion of 106-foot Right--of-Way (known as
N.W. 57th Street) described in Exhibit "A", attached hereto and
made a part hereof, is hereby abandoned, vacated and extinguished
by the City Council of the City of Tamarac, Florida and shall no
longer be deemed property to be used for public purposes on behalf
of the people of the City of Tamarac, Florida.
SECTION_3: Should any section or provision of this Ordin-
ance or any portion thereof, or any paragraph, sentence or word be
declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as.
a whole or any part hereof, other than the part declare to be
invalid. ,

SECTI-ON4- This Ordinance shall become effective upon
approval by the City Council of the final site plan for the
adjoining two parcels; the conveyance of a utility easement for
the vacated right -or -way; and upon payment of the agreed traffic
impact contribution of $40,000, which shall occur no later than
May 13, 1987.
