ATI ORDINANCE A11E'.TDT1V;'1 PRIOR ZONING ORDINANCES, PRO-
VIDING FOR THE REZONING OF CERTAIN REAL PROPERTY
FROM R-4A (PLATINED APARTMENTS) TO B76 (BUSINESS
DISTRICT) UTILIZING THE 5% FLEXIBILITY RULE FOR
COMMERCIAL DEVELOPMENT IN RESIDENTIAL LAND USE AREA
NOT TO EXCEED 10 ACRES; LANDS LYING WITHIN LAND
_SECTION 4, TOWNSHIP 49 SOUTH, RANGE 41 EAST; LANDS
OTHERWISE IDENTIFIED AS BEING THE SOUTHWEST CORNER OF
UNIVERSITY DRIVE AND NW 82 STREET; PROVIDING FOR
AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH
CHANGE; PROVIDING FOR SEVERABILITY; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, pursuant to the instruction of the City Council of
13 he City of Tamarac, Florida, public notice has been given in accordance
14 ith the applicable law of the time and place of public hearing regardin
15 he zoning of the -property described herein and the said public hearing
16 as been held in accordance with the notice and the public has been
17 iven an opportunity to be, and has been heard; and the Council has
18 xamined and investigated the request for the zoning herein and has
19 eceived the recommendation of the Planning Commission of the City of
amarac; and

21 WHEREAS, public hearing has been held on Petition 24-Z-85 by
22 e City Council, pursuant to the Charter:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF

RAC, FLORIDA:

SECTION 1: That those lands described in Exhibit "1" attached
25
reto and made a part hereof are hereby re2oned from R-4A to B-6.

SECTION 2: That the Official zoning Map of the City of Tamarac
27
all be changed to reflect in the zoning, said changes to be initialed
28
the Mayor and the City Clerk, together with the effective date of
29
30 is Ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict
31
rewith are hereby repealed to the extent of such conflict.

SECTION 4: Should any section or provision of this Ordinance
or any portion thereof, or any paragraph, sentence or word be declare
by a Court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remainder hereof as a whole or
any part hereof, other than the part declared to be invalid.
SECTION 5: This Ordinance shall become effective immediately
upon its final passage.
