CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-86- /
AN ORDINANCE.AMENDING PRIOR ZONING ORDINANCES, PRO-
VIDING FOR THE REZONING OF CERTAIN REAL PROPERTY
FROM RM-10 (PLANNED APARTMENTS) TO B-2 (PLANNED
BUSINESS) UTILIZING THE 5% FLEXIBILITY RULE FOR
COMMERCIAL DEVELOPMENT IN RESIDENTIAL LAND USE AREA
NOT TO EXCEED 10 ACRES; LANDS BEING AT THE SOUTHEAST
CORNER OF MCNAB ROAD AND NW 88 AVENUE (OTHERWISE
_IDENTIFIED AS BEING PARCEL R, WOODLAND LAKES, AS RE-
CORDED IN PLAT BOOK 71, PAGE 18, OF THE PUBLIC RECORDS
OF BROWARD COUNTY, FLORIDA); PROVIDING FOR AMENDMENT
OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE;
PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, pursuant to the instruction of the City Council of
he City of Tamarac, Florida, public notice has been given in accordance
ith the applicable law of the time and place of public hearing regardin
he zoning of the property described herein and the said public hearing
�s been held in accordance with the notice and the public has been

ven an opportunity to be, and has been heard; and the Council has

amined and investigated the request for the zoning herein and has
18
ceived the recommendation of the Planning Commission of the City of
19

raca and

WHEREAS, public hearing has been held on Petition 27-Z-85 by
21
CityCouncil, pursuant to the Charter.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF

RAC, FLORIDA:

SECTION 1: That those lands described in Exhibit "A" attached
25
h reto and made a part hereof are hereby rezoned from RM--10 to B-2.

SECTION 2: That the Official Zoning Map of the City of Tamarac
27
s all be changed to reflect in the zoning, said changes to be initialed
28
b the Mayor and the City Clerk, together with the effective date of
29

is Ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict
31
h rewith are hereby repealed to the extent of such conflict.

1 SECTION 4: Should any section or provision of this Ordinance
2 r any portion thereof, or any paragraph, sentence or word be declared

y a Court of competent jurisdiction to be invalid, such decision
4hall-not affect the validity of the remainder hereof as a whale or
5 part hereof, other than the part declared to be invalid.
6 SECTION 5: This Ordinance shall become effective immediately
7 tpon-its final passage.

DESCRIPTIQN:
PARCEL R, WOODLANDS LAKES, according to the Plat thereof, as recorded in
Plat Book 71, Page 18, of the Public Records of Broward County, Florida:
LESS AND EXCEPT therefrom the following described portion:
Beginning at the Northeast corner of said Parcel "R", thence North
t9 01150" West, along the South right-of-way line of McNab Road, a dis-
ance of 380.00 feet; thence south 0°58110" West, a distance of 296.27 feet
o a point on the Easterly line of said Parcel "R"; thence North 53' 01138"
East, along the Easterly line of said Parcel "R", a distance of 481.85 feet
of the Point of Beginning. Containing 9.325 acres, more or less.
Said lands situate, lying and being in Broward County, Florida. Subject to
all easements, reservations, and rights -of -way of records.
(Otherwise identified as being those lands at the
southeast corner of McNab Road and NW 88th Avenue.)
