CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0--86-27y
AN ORDINANCE AMENDING CHAPTER 28, ZONING,
OF THE CITY'S CODE OF ORDINANCES AT ARTICLE
III, PLANNING COMMISSION; PROVIDING FOR THE
ADDITION OF TWO NEW SEATS TO THE CITY'S
PLANNING COMMISSION THROUGH THE AMENDMENT OF
SECTION 28--19 OF THE CITY CODE, CREATED;
COMPOSITION; TERMS OF MEMBERS; POWERS AND
DUTIES; MEETINGS; ELECTION OF OFFICERS;
QUORUM; PROVIDING FOR AMENDMENT OF SECTION
28-22, POWERS AND DUTIES UNDER STATE LAW, BY
AMENDING THE TITLE OF SAID SECTION; BY PRO-
VIDING FOR ADDITIONAL DUTIES AND POWERS
REQUIRED TO BE CARRIED OUT BY THE PLANNING
COMMISSION; PROVIDING FOR CONFLICTING ORDI-
NANCES REPEALED; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; AND PROVIDING

WHEREAS, the City Council deems it necessary and desir-
able to increase the membership of the Planning Commission to
seven (7) members; and
WHEREAS, the Commission hereby vests within the Planning
Commission those powers and duties previously within the
jurisdiction of the Beautification Committee;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SLCTIO� : That Section 28-19 Created; composition;
terms of members; powers and duties generally; meetings;
election of officers; quorum, shall be amended to provide in
full as follows:

Powers and duties, generally; Meetings; Election of
Officers; Quorum.
There is hereby created a Planning Commission consisting
of <five (5) > seve0__j3J_ members, each of whom shall serve for
a term of two (2) years; except, that three (3) of the first
<five (5) > segD_1 1 members of such Commission shall be
appointed for a term of one (1) year, so that the terms of

the members may be staggered, and shall expire on April 15 of
2 the appropriate year.
3 The Council shall appoint no more than <five (5)>
4 alternate members to serve for a term of one (1) year
5 expiring April 15, and in the absence or inability of any
6 regular member of thee Planning Commission shall thereupon
serve in the place of said regular member with all the powers
8 and duties as are vested in the regular member.
9 That Section 28--22, Powers and duties under
10 State Law, shall be amended to provide in full as follows:

12 The Planning Commission created by this article shall
13 have, in addition to the powers prescribed above, all powers
14 and duties of a Planning Commission, as provided by part 11
15 of Chapter 163 of the Florida Statutes; provided, that
16 nothing in this article shall grant to the Planning
'17 Commission any power or duty which is inconsistent with or
18 prohibited by the provisions of State Law with respect to
Planning Commissions.

34 SSCTIOI� 3: Specific authority is hereby granted to
codify this Ordinance.

,5_E�'�IQN 4: All Ordinances or parts of Ordinance in
conflict herewith are hereby repealed to the extent of such
conflict.
5E TTQN�5-: Should any Section or provision of this
Ordinance or any portion thereof, or any paragraph, sentence
or word be declared by a Court of competent jurisdiction to
be invalid, such decision shall not effect the validity of
the remainder hereof as whole or any part hereof, other than
the part declared to be invalid.
SECTION 6: This Ordinance shall become effective
immediately upon its final passage.
