AN ORDINANCE AMENDING CHAPTER 28 OF THE CITY'S
CODE BY THE CREATION OF A NEW ARTICLE, III C,
PLAN ADJUSTMENT COMMITTEE; PROVIDING FOR FORM-
ATION OF A FOUR MEMBER COMMITTEE TO AUTHOR-
IZE MINOR ADJUSTMENTS ON SITE PLAN DESIGN AP-
PROVALS AND LAND SCAPE APPROVALS PREVIOUSLY AP-
PROVED BY THE CITY COUNCIL; PROVIDING FOR MEMBER-
SHIP, JURISIDICTION AND PROCEDURES; PROVIDING FOR
CONFLICTING ORDINANCES; PROVIDING FOR SEVER -
ABILITY; PROVIDING FOR CODIFICATION; PROVIDING
AN EFFECMiyE ,D_$ ,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
5ECT10N] 1: Chapter 28, Zoning, of the City's code
of Ordinances shall be amended the creation of a new Article
III C, Plan Adjustment Committee, which shall provide in full
as follows:
Article III C - Plan Adjustment Committee.
Sec. 28-27.3 Plan Adjustment Committee;
formation; memberships; jurisdiction; procedures.
A. A Plan Adjustment Committee is hereby estab-
lished, which shall be composed of the following
members:
1. That City Council Member appointed as liaison
to the Community Development Committee.
2. The City Planner.
3. The Chief Building Official.
4. The City Engineer.
B. The Plan Adjustment Committee shall have
jurisdiction to make minor adjustments to site plan
design and landscape approvals previously author
ized by the City Council without reconsideration by
City Council.
C. The procedures to be followed by the Plan
Adjustment Committee in considering an application
for adjustment to site plan design and landscape
approval shall be as follows:

1. The proponent of a proposed minor change

5 shall provide the Chief Building Official
with three (3) copies of the approved plan
with the proposed minor adjustments to be
detailed thereon in colored ink or crayon.
2. The Plan Adjustment Committee shall review

the proposed minor adjustment to the site

plan. If all four (4) members of the

Committee are in agreement, they shall sign

the three (3) copies of the adjusted site
13
plan, which shall thereafter serve as an
14
authorized revision to the plan previously
15
approved by the City Council.

3. If any one (1) of the members of the Commi-
mittee is not in agreement with the proposed
18
minor adjustment then said proposal must be
submitted to the full City Council.

4. The findings and actions of the Plan Adjust-

ment Committee shall be recorded in the
22
minutes of the committee meeting and shall
23
be part of the official records of the City
24
of Tamarac, Florida.

5. One (1) copy of the signed revised plan shall
26
be returned to the proponent, one (1) copy
27
28 shall be filed with the final approved
building plans, and one (1) copy shall be
29
attached to the minutes of the Plan Adjust-
30
ment Committee.

6. Any proponent who wishes to have his plan
changed by the Plan Adjustment Committee may

.34 do so only upon payment of an application fee
which shall be established by Resolution.

7. The members of the City Council shall be
notified (in letter form) of any approvals
given by the Plan Adjustment Committee.
2: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION_____: Specific authority is hereby granted to
codify this Ordinance.
SECTION_: Should any section or provision of this
Ordinance or any portion thereof, or any paragraph, sentence
or word be declared by a Court of competent jurisdiction to
be invalid, such decision shall not effect the validity of
the remainder hereof as a whole or any part thereof, other
than the part declared to be valid.
aB9_T_IQN _5: This Ordinance shall become effective
immediately upon its passage.
