Ord. #1265 Rev. 5/23/86 CITY OF TAIIARAC, FLORIDA ORDINANCE NO.� - 1 2 3 4 5 6 7 e 9 10 11 12 13 14 15 20 21 22 23 24 25 26 27 AN ORDINANCE AMENDING CHAPTER 15, MOTOR VEHICLES AND TRAFFIC, OF THE CITY'S CODE OF ORDINANCES, AT SECTION 15-6, PARKING OR STORAGE OF COMMERCIAL OR RECREATIONAL VEHICLES, BOATS OR BOAT TRAILERS; PROVIDING THAT RECREATIONAL VEHICLES AND MOBILE, HOMES SHALL BE PERMITTED TO PARK FOR AS LONG AS A SEVENTY-TWO (72) HOUR PERIOD FOR THE PURPOSES OF LOADING OR UNLOADING, UPON NOTIFICATION AND CONSENT OF THE CITY'S POLICE DEPARTMENT; PROVIDING FOR A REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; - PROVIDING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Chapter 15, Motor Vehicle and Traffic, of the City's Code of Ordinances at Section 15-6, Parking or Storage of Commercial or Recreational Vehicles, Boats or Boat Trailers, shall be amended so that Subsection (4) of said Section shall read in .full as follows: (4) Any prohibited vehicle may be parked or stored in a prohibited area for purposes of loading or unloading on a tem- porary basis; provided, however, any vehicle remaining on the premises for a continuous, twenty-four (24) hour period shall be considered as conclusive evidence that said vehicle is not being loaded or unloaded, and' any of the foregoing vehicles parked_ or stored in a prohibited area for more than two (2) evenings bet- ween the hours of 9:00 p.m. and 6:00 p.m. in any twenty (20) day period shall be considered as being in violation of the prohi- bited parking section of this section. Recreational vehicles and mobile homes shall beper- mitted to park or be stored in a rohibited area for a j2eriod of u to fort -ei ht (48) hours, in addition to that twenty-four (24) hour period permitted by the preceeding paragraph, provided that the owner of said recreational vehicle or mobile home com lies with the following: d Temp. Ord. #1265 Rev. 5/23/86 1 2 3 4 r 5 6i 16 17 9 20 21 22 23 24 25 26 27 29 29 30 'w 31 32 33 34 (a) The owner of- a recreational vehicle or mobile home desiring to ark or store said recreational vehicle or mobile home in a prohibited area for u2 to forty-eight (48) hours, in addition to that twenty-four (24) hourperiod set forth above, must contact the Cit 's police department and request 2ermission to park for such additional period. (b) Where re uired b the Cit 's police department, it may be necessar for the owner to submit any or all manner of reaso- nable proof, including written documents and an application, in order to show that the additional forty-eight (48) hourperiod beina-souaht will be utilized for the purposes of loading or unloading a recreational vehicle or mobile home. Section 2. Should any section or provision of this Ordinance, or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be inva- lid, such decision shall not affect the validity of the remainder hereof, as a whole or a part hereof, other than the part declared to be invalid. Section 3. All section or parts of section of the Code of Municipal Ordinances, all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith, be "and the same, are hereby repealed to the extent of such conflicts. Section 4. It is the intention of the City Council that the provisions of this Ordinance shall become and be madea part of the Code of Ordinances and that the sections of this Ordinance may be renumbered or relettered and the words "Ordinance" may be changed to "Chapter", "Section", "Article" or such other appropriate word or phrase, the use of which shall accomplish the intentions herein expressed.
