AN ORDINANCE AMENDING CHAPTER 15, MOTOR
VEHICLES AND TRAFFIC; OF THE CITY'S CODE
OF ORDINANCES BY THE CREATION OF A NEW
ARTICLE III, DISRUPTION OF TRAFFIC; PRO-
HIBITING THE DISRUPTION OF TRAFFIC AT
CERTAIN LOCATIONS WITHIN THE CITY LIMITS;
PROVIDING FOR PENALTIES; REPEALING ALL
ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR IN-
CLUSION IN CODE; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City wishes to promote the safety of
pedestrians, bicyclists, and occupants of motor vehicles in con-
nection with the use of public thoroughfares; and
WHEREAS, the City wishes to promote the smooth and
orderly flow of vehiclular and bicycle traffic; and
WHEREAS, the City Council recognizes that certain
stretches of public thoroughfares within the City limits are par-
ticularly congested; and
WHEREAS, the City wishes to adopt effective safety
measures which are narrowly drawn so as to effectively combat
particular problem areas while having as minimal an impact upon
protected first amendment activities as possible; and
WHEREAS, Florida Statutes §316.008(g) reserves to local
authorities the power to -.restrict the use of streets;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC:
Section 1. Chapter 15, Motor Vehicles and Traffic, of
the City's Code of Ordinances is hereby amended by the adoption
of a new Article III, Disruption of Traffic, which shall read in
full as follows:
ARTICLE III. DISRUPTION OF TRAFFIC.
Sec. 15-20 Disruption of traffic - orohibited
(1) At those locations described in subsection
(4) of this section, no person shall willfully
stand upon, walk upon, place objects upon, or
otherwise occupy a vehicular street, roadway or
thoroughfare, except for the limited purpose of
crossing from one side thereof to the other, un-
less such person is occupying a motor vehicle or
propelling a bicycle in compliance with Florida
Statute §316.111.
(2) No person shall employ or otherwise furnish
consideration to another person for services.ot
activities and direct such other person to vio-
late, or explicity or implicity consent to such

other person's violation of, subsection (1) of
this section during the course of such services
,or activities.
(3) The term "person" as used in this section shall
include any natural person or individual, or any firm,
partnership, association, limited partnership, sole
proprietorship, corporation, or any business entity
whatsoever.
(4) The provisions of this section shall apply
between the outermost edges of the paved roadway,
or between the outermost curb lines of the road-
way where such curb lines do exist, and shall also
apply to the median, if any, at the following
locations:
a. Along the course of Commercial Boule-
vard from its intersection with
State Road 7 (U.S. 441) westerly
for a distance of 150 feet;
6. Along the course of Commercial Boule-
vard from its intersection with
State Road 7 (U.S. 441) easterly
for a distance of 150 feet;
c. Along the course of State Road 7
(U.S. 441) from its intersection with
Commercial Boulevard northerly
for a distance of 150 feet;
d. Along.. the course of State Road 7
(U.S. 441) from its intersection
with Commercial Boulevard southerly
for a distance of 150 feet;
e. Along the course of West Commercial
Boulevard from its intersection with
university Drive westerly for a
distance of 150 feet;
f. Along the course of West Commercial
Boulevard from its intersection with
University Drive easterly for a dis-
tance of 150 feet;
g. Along the course of University Drive
from its -intersection with West Commercial
Boulevard northerly for a distance of
150 feet;
h. Along the course of University Drive
from its intersection with West Commercial
Boulevard southerly for a distance of
150 feet.
(5) Any person who violates any provision of this
section shall, upon conviction thereof, be punished
by a fine of not less than Fifty ($50.00) Dollars,
and not more than Five Hundred ($500.00) Dollars or
by imprisonment for not more than thirty (30) days,
or by both such fine and imprisonment.
Section 2. All sections or parts of sections of the Code
of Municipal Ordinances, all ordinances or parts of ordinances
and all resolutions or parts of resolutions in conflict herewith,
be and the same, are hereby repealed to the extent of such
conflicts.

Section 3. Should any section or provision of this
Ordinance, or any portion thereof, or any paragraph, sentence or
word be declared by a Court of competent jurisdiction to be inva-
lid, such decision shall not affect the validity of the remainder
hereof, as a whole or a part hereof, other than the part declared
to be invalid.
Section 4. It is the intention of the City Council that
the provisions of this Ordinance shall become and be made a part
of the Code of Ordinances and that the sections of this Ordinance
may be renumbered or relettered and the words "Ordinance" may be
changed to "Chapter", "Section", "Article" or such other
appropriate word or phrase, the use of which shall accomplish the
intentions herein expressed.
Section 5. This Ordinance shall be in force and take
full effect immediately upon its passage and final adoption.
