Ord. #1273 CITY OF TAMARAC, FLORIDA 1 ORDINANCE NO. 0-86- 2 3 AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA, AMENDING ORDINANCE NO. 77-16 (CITY CODE SECTION 4. 4-2); DEFINING THE TERM "OWNER"; PROVIDING FOR PENALTIES; PROVIDING FOR SEVERABILITY; PROVIDING S FOR REPEALER; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECT13LE ATE. b 7 WHEREAS, the City Council wishes to provide for the 8 health, safety, and welfare of its residents by eliminating the 9 hazards of stray, roaming, and unleashed animals; and 10 -WHEREAS, the City Council perceives the need to expand the 11 responsibility for such hazards so as to include persons who 12 harbor such animals as well as persons who have obtained a 13 license for such animals; and 14 WHEREAS, the City Council deems it necessary for the IS health, safety, and welfare of its residents to provide for a 16 minimum penalty and to give the presiding judge authority to 17 order the humane destruction of such animals. 18 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 19 OF TAMARAC, FLORIDA: 20 SECTION_1: That Section 1 of Tamarac City Ordinance No. 21 77-16 is hereby amended by adding the following provisions: 22 (d) The term "owner" as used in this section 23 shall be defined as any person owning, harbor- 24 ing, or maintaining custody of an animal. 2S (e) Notwithstanding any other provision of the 26 City Code, any person who violates subsection 27 (a), upon conviction, shall be punished by a 28 fine of not less than fifty dollars ($50.00) and 29 not more than five hundred dollars ($500.00), or 30 31 by imprisonment for a term not to exceed sixty 32 (60) days, or by both such fine and 33 imprisonment. The judge rendering sentence for 34 such violation shall, in addition to the foregoing fines and imprisonment, be authorized to order the Chief of Police to cause such animal to be humanely destroyed. Temp. Ord. #1273 SECTION 2: All sections or parts of sections of the Code of Municipal Ordinances, all Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith, be and the same, are hereby repealed to the extent of such conflicts. ,SECTION 3: Should any section or provision of this Ordinance, or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof, as a whole or a part hereof, other than the part declared to be invalid. SECTION 4: It is the intention of the City Council that the provisions of his Ordinance shall become and be made a part of the Code of Ordinances and that the sections of this Ordin- ance may be renumbered or relettered and the words "Ordinance" may be changed to "Chapter", "Section", "Article" or such other appropriate word or phrase, the use of which shall accomplish the intentions herein expressed.
