ORDINANCE No. 0-89-__L-
AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA
RELATING TO THE AMOUNT OF MUNICIPAL EXCISE
TAX CHARGED TO CASUALTY INSURANCE PREMIUMS
UNDER CHAPTER 185 FLORIDA STATUTES; REDUCING
THE AMOUNT OF SAID TAX FROM ONE (1) PER CENT
TO POINT EIGHT FIVE (.85) PER CENT; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Florida Legislature has recently amended
Chapter 185 of the Florida Statutes to reduce the amount of
excise tax to be levied by municipalities on casualty
insurance premiums; and
WHEREAS, the City Council of the City of Tamarac wishes
to amend the Code of Ordinances of the City of Tamarac to
reflect this change to State Statutes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That Division 1, "Casualty", Sections 14-55
through 14-58 of the Code of Ordinances of the City of
Tamarac are hereby amended to read as follows:
Sec. 14-55. Tax --Imposed.
There is hereby assessed, imposed and levied on
every insurance company, corporation or other insurer now
engaged in or carrying on, or who shall engage in or carry on
the business of casualty insurance as shown by the records of
the Department of Insurance, an excise or license tax in
addition to any lawful license or excise tax now levied by
the city.

Attached herewith please find two proposed ordinances
for the City Council Meeting of December 28, 1988:
1) An Ordinance of the City of Tamarac, Florida
relating to the amount of Municipal Excise Tax
charged to Casualty Insurance Premiums under
Chapter 185 Florida Statutes; reducing the amount
of said tax from one percent to point eight five
percent; providing for severability; providing for
codification; and providing for an effective date.
and
2) An Ordinance of the City of Tamarac, Florida
relating to the amount of Municipal Excise Tax
charged to property insurance premiums under
Chapter 175 Florida Statutes; reducing the amount
of said tax from two percent to one point eight
five percent; providing for severability; providing
for codification; and providing for an effective
date.

Sec. 14-56. Same --Amount.
The amount of said excise or license tax referred to in
section 14-55 shall be one-jl} point eight five (.85) per
cent of the gross amount of receipts of premiums from policy
holders on all premiums collected on casualty insurance
policies covering property within the corporate limits of the
city.
Sec. 14-57. Multiple peril policies.
In case of multiple policies with a single premium for
both property and casualty coverages in such policies, thirty
(30) per cent of such premium shall be used as the basis for
the one Point eight -five (.85) per cent tax above.
Sec. 14-58. Term.
Said license or excise tax herein levied and assessed
shall be due and payable annually on the first day of March
of each year hereafter.
SECTION 2: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be sever-
able.
SECTION 3:
Specific authority is hereby granted to
codify this Ordinance.

SECTION 4: This Ordinance shall become effective
immediately upon adoption and passage.
