AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA
RELATING TO THE AMOUNT OF MUNICIPAL EXCISE
TAX CHARGED TO PROPERTY INSURANCE PREMIUMS
UNDER CHAPTER 175 FLORIDA STATUTES; REDUCING
THE AMOUNT OF SAID TAX FROM TWO (2) PER CENT
TO ONE POINT EIGHT FIVE (1.85) PER CENT;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Florida Legislature has recently amended
Chapter 175 of the Florida Statutes to reduce the amount of
excise tax to be levied by municipalities on property
insurance premiums; and
WHEREAS, the City Council of the City of Tamarac wishes
to amend the Code of Ordinances of the City of Tamarac to
reflect this change to State Statutes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That Division 2, "Property", Sections
14-58.1 through 14-58.4 of the Code of Ordinances of the City
of Tamarac are hereby amended to read as follows:
Sec. 14-58.1. Tax --Imposed.
There is hereby assessed, imposed and levied on
every insurance company, corporation or other insurer now
engaged in or carrying on, or who shall engage in or carry on
the business of property insurance as shown by the records of
the Department of Insurance, an excise or license tax in
addition to any lawful license or excise tax now levied by
the city.

WHEREAS, the Florida Legislature has recently amended

WHEREAS, the City Council of the City of Tamarac wishes
to amend the Code of Ordinances of the City of Tamarac to
reflect this change to State Statutes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That Division 2, "Property", Sections
14--58.1 through 14-58.4 of the Code of Ordinances of the City
of Tamarac are hereby amended to read as follows:
Sec. 14-58.1. Tax ---Imposed.
There is hereby assessed, imposed and levied on
every insurance company, corporation or other insurer now
engaged in or carrying on, or who shall engage in or carry on
the business of property insurance as shown by the records of
the Department of Insurance, an excise or license tax in
addition to any lawful license or excise tax now levied by
the city.

Sec. 14-58.2. Same --Amount.
The amount of said excise or license tax referred to in
section 14-58.1 shall be twe_i2} one__j2oint eight five
(1.85) per cent of the gross amount of receipts of premiums
from policy holders on all premiums collected on property
insurance policies covering property within the corporate
limits of the city.
Sec. 14-58.3. Multiple peril policies.
In case of multiple policies with a single premium for
both property and casualty coverages in such policies,
seventy (70) per cent of such premium shall be used as the
basis for the twe-J2} one Dint ei ht five (1.85) per cent
tax above.
Sec. 14-58.4. Term.
Said license or excise tax herein levied and assessed
shall be due and payable annually on the first day of March
of each year hereafter.
SECTION 2: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be sever-
able.
SECTION 3•
Specific authority is hereby granted to
codify this Ordinance.

Wednesday, January 25, 1989, at or after 10:00 A.M. and will

on the agenda. The Regular Meeting of the City Council will
be held at City Hall, 7525 N.W. 88th Avenue, Tamarac,
Florida, 33321.
Copies of these proposed Ordinances are available for viewing
and purchase at the office of the City Clerk. Interested
parties may appear to be heard with respect to these proposed
Ordinances in accordance with Florida Statute #166.041.
