CITY OF TAMARAC, FLORIDA
ORDINANCE No. 0-89--iz0
AN ORDINANCE OF THE CITY OF TAMARAC RELATING
TO THE DUTIES OF THE BOARD OF ADJUSTMENT;
AMENDING ARTICLE II, SEC. 28-13 OF THE CODE
OF ORDINANCES OF THE CITY OF TAMARAC TO
DELETE THE REQUIREMENT THAT THE BOARD OF
ADJUSTMENT HEAR SPECIAL EXCEPTIONS; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Florida case law provides that local Board of
Adjustments are not authorized to approve use variances; and
WHEREAS, the City Council of the City of Tamarac wishes
to amend the City Code to delete any reference to use
variances; and
WHEREAS, this Ordinance has been considered at a Public
Hearing and the City Council has determined that its adoption
is in the public interest,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION I : That Article II, Section 28-13 of the Code
of Ordinances of the City of Tamarac relating to the powers
and duties of the Board of Adjustment is hereby amended to
read as follows:
Sec. 28-13. Powers and duties generally.
The board of adjustment shall have the following powers
and duties:
(a) Appeals. To hear and decide appeals when it is
alleged that there is error in any order, require-
ment, decision or determination made by an admini-

strative official in the enforcement of any zoning
ordinance or regulation adopted.

SECTION 2 : If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not effect other provisions or
applications of this Ordinance that can be given affect
without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be sever-
able.
SECTION 3 Specific authority is hereby granted to
codify this Ordinance.
SECTION 4 This Ordinance shall become effective
immediately upon adoption and passage.
