Ord. ##1443 Revised 10/3/89 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-69- •:f AN ORDINANCE AMENDING CHAPTER 21, OF THE TAMARAC CITY CODE BY AMENDING ALL SECTIONS THEREOF, TO PROVIDE FOR REGULATION OF THE CONSTRUCTION, ERECTION, PLACEMENT, REPAIR, ALTERATION, LOCATION AND MAINTENANCE OF SIGNS WITHIN THE MUNICIPAL BOUNDARIES OF THE CITY OF TAMARAC; PROVIDING FOR APPLICATION AND PERMIT PROCEDURES; PROVIDING FOR PERMIT AND RENEWAL FEES TO BE ESTABLISHED BY RESOLUTION OF COUNCIL; PROVIDING FOR .PERIODIC INSPEC- TIONS; PROVIDING FOR THE REVOCATION OF PERMITS AND PROCEDURE THEREFOR; PROVIDING PROCEDURES FOR WAIVER AND EXCEPTION; PROVID- ING FOR NONCONFORMING SIGNS; PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT HERE- WITH, SPECIFICALLY REPEALING SECTION 21-1 THROUGH 21-14 OF THE CITY CODE= PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR PENAL- TIES; PROVIDING FOR CODIFICATION; AND TROVID- ING AN EFFECTIVE DATE. WHEREAS, the Sign Advisory Task Force Committee has recommended that the current sign regulations be repealed and replaced with new sign regulations; and WHEREAS, the new regulations were presented to the Planning Commission at its meeting of August 16, 1989; and WHEREAS, the Planning Commission has recommend that the City Council approve the proposed changes to the sign regulations. (9) BENCH SIGN : Any sign painted on or attached to a bench or shelter for persons awaiting public transportation on or adjacent to a public right-of-way. (10) BILLBOARD SIGNS : A Structure utilized for advertising an establishment, an activity, a product, service or entertainment, which is sold, produced, manufactured, available or furnished at a place other than on the property on which said sign is located. (11) BLACK : For purposes of sign criteria, black is considered a color. (12) BOX OR CABINET SIGN Any type of sign affixed to a building fascia, wall or parapet wall, the face of which is enclosed, bordered or contained within a box -like structure, frame or other device. (13) BUILDING ADDRESS SIGN : A sign indicating the street address (es) of a building (s) . (14) CANOPY An ornamental roof -like structure (See Marquee). (15) CANOPY SIGN : See Marquee Sign. (16) CANTILEVER SIGN : The same type of sign as Projec- tion Sign, one directly attached to and extending from a building or other structure. (17) CHANGEABLE COPY SIGN : A sign that is designed so that characters, letters or illustrations can be changed or rearranged without altering the face of the surface of the sign. (18) CITY : The City of Tamarac, Florida. (19) COLD AIR BALLOONS : An inflatable balloon used for advertising purposes, not filled with hot air. (20) COMMUNITY : A complete and occupied residential area within distinct geographic boundaries defined by plat or site plan. (32) ELECTRONIC MESSAGE CENTER : A changeable copy, lit sign that moves and/or flashes to create an illusion of movement for the purposes of advertising, promotion or attention getting with or without copy (Similar to a "Scoreboard".) (44) INFORMATION SIGN : See General Information sign or Use -related information sign. (45) INTERNAL ILLUMINATION A light source concealed or/contained within the sign which becomes visible. (46) ITEM OF INFORMATION : Each syllable or abbreviation contained on a sign. (47) LEASING SIGN : A sign indicating the availability of property, for lease or rent. (48) LOGO : A design, figure, illustration or distinctive style of lettering used to identify a specific product, service or business entity whether registered or not. (49) MANSARD WALL : A sloping section of an exterior wall extending above the roof line of a building at an angle with the exterior wall from which it extends. It may be covered with roofing material to simulate a roof but serves as aesthetic rather than functional purpose. (50) MARQUEE A permanent canopy projecting over an entrance. A canopy or marquee is not an integral part of the roof, but rather, is appended to the building and extend: beyond the building or building line. (66) POLE SIGN : A sign erected upon one (1) or more poles or posts and which is wholly independent of any building and/or other structure for support. Also referred to as a "plyon sign". (67) POLITICAL SIGN : A sign used to indicate the name, cause or affiliation of anyone seeking public office or which indicates any issue for which a public election is scheduled to be held. (68) PREMISES : The real property considered a unit. (69) PRICE RATE SIGN : A sign used to indicate product or services prices. (70) PROHIBITED SIGNS See Illegal Signs. (71) PROJECT SIGN : A sign which announces the construc- tion of a building, structure or group thereof. (72) PROJECTING SIGN : A type of sign that is directly attached to and extending from a building or other structure. (73) PROMOTIONAL SIGN : A sign announcing a promotional activity sponsored by the owner or agent of the property and located on the site of the event. (74) PYLON SIGN : A sign erected upon a towerlike structure, or pole, which is wholly independent of any building or other structure for support. (75) REAL ESTATE SIGN : A temporary sign erected by the owner or agent, indicating property which is for rent, sale or lease. (76) RELIGIOUS SIGN : A shape symbolizing a religious belief. (77) REMODELING CONTRACTOR SIGN : A temporary sign used to identify the name of the general contractor or subcontrac- tor or both, which is remodeling or renovating an existing structure, whether commercial or residential. (90) TRAFFIC -CONTROL SIGN Any sign used to control traffic on public or private property, such as "One Way," "Do Not Enter," etc. (See also "Directional Sign") (91) TRAILER SIGN : A sign placed in, on or attached to a portable or mobile device or a device that may be made portable or mobile. (92) UNIFORM SIGN PLAN : A sign plan for more than one business use setting forth standards for uniform sign area, letter style, letter height, sign colors and other character- istics and approval by the Chief Building Official. The bond shall be called by council and the removal of existing signs authorized only if signs which do not conform with the new criteria are not removed within 120 days. SEC.21-4 TEMPORARY SIGNS Only such temporary signs as are prescribed herein, which conform with the provisions of this chapter, shall be permitted to be erected or maintained upon any building lot, parcel of land, or leasable space. No free-standing signs so permitted, however, shall exceed six (6) feet in height above the road measured at the edge of the pavement. No wall or window sign so permitted shall be located higher than the second story. No temporary sign shall be permitted in the public right-of-way. No temporary sign less than four square feet shall require a permit, except for all temporary banner signs and any temporary sign which requires electrical' to function,shall require a permit and shall be installed by a licensed contrator. All temporary signs shall comply with all regulations with this ordinance. Regulation for temporary signs in all zoning districts shall be as follows: A. REAL ESTATE SIGNS (1) One (1) free-standing real estate sign shall be permitted per street front per lot. a. Sign area is not to exceed three (3) square feet per sign face. Individual commercial enterprises may qualify for a special occasion sign, banner or decoration permits such as, but not limited to a bona fide going -out -of business sale, or changes in ownership or management, or grand opening, or holiday. It shall not exceed thirty (30) days total within one year for all occasions and shall not exceed two times per year total for all occasions, unless applicant can demonstrate change of ownership during any one calendar year. b. Signs for sidewalk sales may be permitted no more than two (2) times each calendar year. The maximum time for sign display shall be one (1) week. C. Noncommercial entities may qualify only for special event directly related to their function or purpose. Except for holidays, these signs may be displayed only during and up to fifteen (15) days prior to the special event to which they relate and must be removed within seventy- two (72); hours after the event. POLITICAL SIGNS 1. Location. a. Political signs shall be permitted to be erected as of the date of the qualification for office by the candidate or thirty (30) days prior to the date of the election for registered political parties. b. All political signs shall be removed no later than ten (10) days following the date of the election to which they pertain by those persons responsible for their placement. All signs shall be discarded in a proper manner so as to prevent litter and trash from accumulat- ing in the City. c. No political signs shall be permitted to be posted in any public right-of-way or in public parks. d. The prohibition contained in this subsection shall in no way apply to election announcement signs posted by the City, announcing each election to be held in the City. e. Political signs, as defined herein, are permitted on private property with the written permission of the record title holder of said property. f. Two (2) directional signs permitted not to exceed nine (9) square feet per sign face and an aggregate of eighteen (18) square feet. 3. A bond shall be posted with the Building Department in an amount set by resolution of the City Council. Said bond shall be forfeited if the sign is not removed within five (5) days following the close of the picking season. SEC. 21-5. PERMANENT SIGNS Only such permanent signs detailed herein below shall be permitted to be erected or maintained upon any building, lot, or parcel of land. Sign location shall be governed by the applicable zoning district regulations of this code. Permits for signs for existing buildings and uses may be reviewed and issued by the Building Department based upon consistency with the sign criteria or the signage regulations then in effect. All new or revised sign criteria for existing buildings that are consistent with the City of Tamarac signage regulations shall be reviewed by the Chief Building official. A. PERMITTED SIGNS 1. Signs installed under the direction of federal, state, county or municipal agencies with the approval of the Building Official shall be permitted. 2. Flags of the United States, State of Florida and the City of Tamarac are permitted. No more than three (3) flags shall be permitted on any site. Flag pole locations shall be shown on approved site plans. All other flags shall be considered a method of advertisement. 3. General information signs are permitted and shall not exceed three (3) square feet in area. 4. One nameplate sign per residence or business shall be permitted. It shall not exceed one and one-half (1 1/2) square feet in total area and shall be attached to a front wall. It shall consist of individual letters not exceeding six (6) inches in height. 5: Logo Signage. All permitted logos must be registered or copyrighted trademarks. If the logo is not registered, it is considered a sign and not a logo for the purposes of this Chapter. a. Logos shall not be larger than the height of the adjacent letters, as described in the sign criteria for the project. b. Logos shall be no more than two colors, unless the third color is the color background, as shown on the, sign criteria. 6. Commercial vehicles witts signs shall be parked in a garage, carport or fully -screened landscaped area. D. COMMERCIAL, INSTITUTIONAL, EDUCATIONAL, RECREATIONAL DISTRICTS. A master sign plan shall set standards for all signs within the master development that are within 100 feet of a public right-of-way or private road. 1. Ground/Monument Identification Sign. a. The name of the business or office may be derived from the main use of the premises, development name or business name. The copy shall include the street number. Street number shall be put on the top of the sign. b. Ground signs shall not exceed twelve feet in height above the road measured at the edge of pavement adjacent to the sign. In all other districts ground signs shall not exceed six (6) feet in height above the road measured at the edge of pavement C. Sign letter height shall not exceed the base height limitations as delineated in Section 21-7 of this Chapter for monument signs. 2. Front or Facade Identification Sign. a. One (1) front identification sign per store front, not to exceed the limitations delineated in the Basic Design Schedule, shall be permitted in the front of the building. For purposes of this Chapter the store front is the portion of the building containing the principal customer entrance or which faces the primary street. In no instance shall the width of the front identification sign be wider than 80 percent of the frontage of the store or bay(s) and/or the signage panel. In rio instance shall the height of the identification sign be higher than 80 percent of the front facade. b. Establishments with double store fronts with corner bays are permitted two signs. One sign is permitted on the primary store front and one is permitted facing the major street or internal circulation route. Outparcel building signage is regulated by this provision. Directory Signs. a. Two (2) directory signs are permitted where there are two (2) or more buildings in a complex. b. A directory sign may identify the complex by name and the location and name of the building or bay tenants. c. Said signs may not exceed twelve (12) square feet per sign face and an aggre- gate sign area of 24 square feet which shall meet the uniform sign plan. d. Complex name must be in letters not to exceed six inches in height. Building or tenant name must be in letters not to exceed four inches in height. e. Each building name, use, activity, or service sign shall not exceed two (2) square feet in sign area. f. The sign shall not exceed four (4) feet in height. g. The sign shall not be placed closer than 50 feet from property line. h. Interior corner bays or interior offices are permitted one directory sign. 7. Hotel and Motel Signs. In districts where hotels and motels are permitted, signs indicating the availability of accommodations in the hotels or motels will be permitted provided said signs do not exceed three (3) square feet within the allowable sign area provisions of this section. B. Business Hours Signs. One (1) sign per entrance which advertises the hours of business and does not exceed one and one --half (1 1/2) square feet in area or four (4) inches in letter height is permitted. E. INDUSTRIAL (LI-1) ZONING DISTRICTS. 1. Permitted signs in Industrial Parks or Projects developed as a Unit. (a) Two (2) entry wall signs or one (1) primary ground/monument advertising the main use of the project and/or the business shall be permitted. (1) The sign(s) shall be located only along the principal access road or primary entrance. (2) Each sign face area is not to exceed 24 square feet and the total aggregate sign area shall not to exceed forty- eight (4 8 ) square feet. (3) The sign shall not exceed six feet in height above the road measured at edge of pavement. (4) Letter height shall not exceed 24 inches. (b) One (1) secondary ground or entry wall sign advertising the name of the project may be located along each road frontage of the project. (1) The sign may be located along a secondary access road or if along principal access frontage must be at least 400 feet from primary project sign. (2) Each sign face area is not to exceed 16 square feet and the total aggregate sign area not to exceed 32 square feet. (3) The sign shall not exceed six feet in height. (c) One (1) front facade identification sign for each bay or use, not to exceed the limitations in Section 21-7. shall be permitted on the front of the building. For purposes of this Chapter the bay or use frontage is the portion of the building containing the principal visitor/customer entrance. (4) All wood permitted to be -used, either for new signs, for replacement of existing signs or for any part hereof, shall be of rot -and deterioration - resistant materials. (5) Temporary signs permitted by these regulations shall not exceed six (6) feet in height above the crown of adjacent roads or existing ground eleva- 6 tion, whichever is higher. In a free-standing building occupied by a single tenant, a logo design, illustra- tion, figure or logo -style of lettering is permitted only on a wall, ground or window sign. b. In a multiple -tenant complex or shopping center a tenant may display a logo design, illustration or figure on a wall sign or in a window in the same color as the letters. (11) Changes of copy in permitted changeable copy signs (12) No permit shall be required for refurbishing a sign, provided copy is not changed and provided that the cost of any repair does not exceed fifty (50) percent of the original cost of the sign and provided no electrical work, except for normal maintenance, is necessary. SEC. 21--12 NONCONFORMING SIGNS A All signs subject to this chapter and not in conformance with the regulations enumerated herein shall be required to come into compliance within twelve (12) months from the date of adoption of this Ordinance. B Where a nonconforming sign exists, such sign shall be brought into conformance with this chapter or removed when the name of the enterprise or business advertised or the copy on the sign is changed. This shall be done prior to issuance of an occupational license for any new business or enterprise. SEC. 21-13.
