Ord. #1444 Revised 9/25/89 CITY OF TAMARAC; FLOIQIDA ORDINANCE No. 0-89-.3,2— AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA AMENDING CHAPTER 28 OF THE CODE OF ORDIN- ANCES; AMENDING SECTION 28-171 "MASTER LIST ENUMERATION", BUSINESS USES; PERTAINING TO DISTANCE REQUIREMENTS FOR DELICATESSENS AND RESTAURANTS IN SPECIAL EXCEPTION REQUIRE- MENTS; PROVIDING FOR CLARIFICATION OF THOSE DISTANCE REQUIREMENTS; PROVIDING FOR CODIFI- CATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. _ WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac deter- mines that it is in the public interest to adopt the follow- ing Ordinance: WHEREAS, the following amendment will clarify the distance requirements for delicatessens and restaurants in the special exception requirements. Ord. #1444 Revised 9/25/89 Delicatessen, retail special exception* Delicatessens can create certain odors, generate garbage of large quantities which may attract vermin and insects and accordingly must be separated by a sufficient buffer and contain other standards to protect the health, safety and welfare of the people. Accordingly, this use is permitted by special exception in B-1 and B-2 districts. In addition to other requirements, the following criteria must be met: (1) The commercial bay or free standing structure containing the establishment shall be at least 100 feet from the nearest residential property line measured in a straight line from the closed point of the structure or bay containing the delica- tessen. (2) There must be prior approval of the means and method of waste collection by the city council. (3) A plan for control, reduction or elimination of offensive odors should be submitted with the application for special exception to the City, (4) There must be an on -premise kitchen which contains facilities for the Pre2aration of foods. Kitchens must include but are not limited to, the following: sinks, stove, ovens, refrigerators, re aration tables, packagingand storage equipment used in the on -site preparation of food. SECTION 3 Specific authority it hereby granted to codify this Ordinance.
