Ord. #1436 Revised 9/18 8899 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-89-1-53 AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA AMENDING CHAPTER 28 OF THE CODE OF ORDIN- ANCES; ARTICLE XX, L1-1, LIGHT INDUSTRIAL DISTRICT; AMENDING SECTION 28-182, PERMITTED USES TO DELETE ALL B-3 USES; AMENDING SECTION 28-185 REGARDING PLOTS OF FIVE ACRES OR LESS; CREATING SECTION 28-188 FOR YARD SETBACKS, PLOT COVERAGE, OPEN SPACE REQUIREMENT, BUILDING HEIGHT AND HOURS OF OPERATIONS; PROVIDING FOR CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, plots of five acres or less in the Light Indus -- trial Zoning District currently have no yard setbacks; and WHEREAS, the City of Tamarac wishes to establish yard setbacks for plots of five acres or less located in the Light Industrial Zoning District; and WHEREAS, the City Council of the City of Tamarac has determined that it is in the public interest to adopt the following Ordinance; and WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 : That Section 28-182 of the Code of Ordin- ances of the City of Tamarac entitled "Permitted Uses" is hereby amended to read as follows: 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 1 21 22 23 24 25 26 27 28 29 30 3� 33 34 35 Sec. 28-182. Permitted Uses No building or structure or part thereof, shall be erected, altered or used, or land or water used, in whole or in part, for other than one (1) or more of the following uses: �e}--�4np-+sae-perm+Ytted-in-e-B--3--diatrYet--except-da pre�iibited-in-aeetien-�9-�93: {b} (a) Permitted Uses: Assembly uses: Automobile accessories, except tires. Boxes/corrugated. Candles. Optical equipment, cameras and equipment. Televisions, radios, phonographs, tape recorders. Handbags. Electrical fixtures. Electronic devices. Printing, publishing, lithography and engraving. Manufacturing uses: Ice Cream. Jewelry. Musical instruments. Precision instruments. Small parts and devices. Individual uses: Carpenter and cabinet shop. Stationery, printing of. Motion picture studio. Pattern making. Convention center/exhibition hall. Plumbing or electrical shop entirely within an enclosed building. Warehouses and storage buildings (special exception). SECTION 2 : That Section 28--185 of the Code of Ordin- ances of the City of Tamarac entitled "Plot Size" is hereby amended to read as follows: Sec. 28-185. Plot Size There shall be no minimum required size of plot, except there shall be at least one (1) acre for each freestand- ing building or structure; except that any industrial - zoned, unimproved platted lot of five acres or less than-ene--**-sere in [an] area within the city limits as of the effective date of this article shall be -exempt from-tfixa-preb�eaien be subject to special regulations as set forth in Section 28-188. 1 2 3 5 6 7 8 9 10 11 12 13 14 15 16 17 1$ 1' 2( 21 22 23 24 25 26 27 28 29 30 31 3 33 34 35 SECTION 3 : That Section 28-188 is hereby created and made a part of the Code of Ordinances of the City of Tamarac to be entitled "Special Regulations" and shall read as follows: Sec. 26-188. Special Regulations For Lots of Five Acres or Less (1) The maximum im ervious area allowed is 30% of net lot area. (2) The minimum "open space" required is 20% of net lot area. Openspace is defined as non-im ervious, non - water area. (3) The maximum building height allowed shall be three (3) stories. (4) The re uired front yard along a Broward Count Tra-fficway or any collector or greater street shall be at least 75 feet and shall incorporate a land- sca a buffer yard of at least 20 feet. For every 100' of frontage there shall be 4 canopy trees. 8 understory_trees, 24 shrubs, and 12 street trees. Any--industrial-zoned, unimproved platted lot of one (1) acre or less in area may use required 75' front yard setbacks for walkways, parking, drive- yys and loadin zones. (5) The required front yard alon rivate streets or city street which are less than collector streets shall be 20 feet and shall incoK2orate a landscape buffer yard of at least 20 feet. 1 2 3 4 5 b 01 3,- 33 34 35 (6) Fences, walls, landscaped buffers. A six (6) foot high solid masonry wall (stuccoed and painted), shall be required along any 2rMeEtyline-abut n residentially zoned or an_S-1 zoned district. A ten foot landscaped buffer strip on the interior side of such wall shall be planted with shade trees ten (10) feet high at the time of planting, spaced no farther than twenty five (25) feet apart, center to center. (7) No outside storage material, su lies, finished roducts or equipment -shall be permitted. (8) Regulations on signage (Ch. 21),.lighting_(Ch. 18), arkin (Ch. 18) and landscaping (Ch. 6), except as s2ecifica_lly amended by this ordinance, shall be re uired as specified in other chal2ters of the Cit of Tamarac Code. SECTION 4 Specific authority is hereby granted to codify this Ordinance. SECTION 5 All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6 : If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able.
