'CITY OF TAMARAC, FLORIDA
ORDINANCE No. 0-89
AN ORDINANCE OF THE CITY OF TAMARAC RELATING
TO BINGO; AMENDING ARTICLE X, SECTION 14-75
OF THE CITY OF TAMARAC CODE OF ORDINANCES TO
PROVIDE THAT BINGO SHALL NOT BE PERMITTED AT
ANY SPECIFIC SITE, LOCATION OR ADDRESS MORE
THAN FOUR (4) TIMES A WEEK; PROVIDING FOR
C0DIFICATIION; PROVIDING FOR SEVERABILITY;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Florida Statutory law recognizes an exception
to the State prohibition against gambling by permitting bingo
to be conducted by charitable, non profit organizations; and
WHEREAS, the Florida Legislature through, Section
849.093, Florida Statutes, created exceptions to the
prohibition against gambling whereby charitable, nonprofit
and veterans' organizations can conduct bingo games to raise
funds for worthy purposes or whereby such organizations can
conduct bingo and guest games if all the proceeds are
returned to the players as prizes; and
WHEREAS, this 'statutory exception is aimed at authoriz-
ing amateur, charitable, non profit organizations to conduct
bingo games; and
WHEREAS,. when professional organizations take over the
operation of bingo games, the resulting increased bingo
activity makes professional bingo operations attractive to
illegal gambling interests; and
WHEREAS, the City Council of the City of Tamarac,
Florida, intends'to regulate bingo so as to prevent its
exploitation by illegal gambling interests in the City of
Tamarac; and

WHEREAS, the City Council of the City of Tamarac,
Florida, deems it necessary to regulate bingo games within
the geographical limits of the City of Tamarac, Florida;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are
hereby ratified and confirmed as being true and correct and
are hereby made a specific part of this Ordinance upon
adoption hereof.
SECTION 2: That Article X, Section 14-75 of the City of
Tamarac Code of Ordinances entitled "Limitation" is hereby
amended to read as follows:
Sec. 14-75. Limitation.
A limitation is hereby imposed on any charitable, civic,
community, benevolent, religious, scholastic, fraternal and
veteran's organizations, together with condominium associa-
tions or planned community associations, receiving an annual
permit, restricting the conduct of bingo games by a permitted
organization to two (2) sessions, day or night, per week. In
addition, bingo shall not be conducted „at a,s2ecific site,
location or address more than four (4) times a week.
SECTION 3: Specific authority is hereby granted to
codify this Ordinance.
SECTION 4: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given affect

without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be sever-
able.
SECTION 5: This Ordinance shall become effective
immediately upon adoption and passage.
