Ord. #mow CITY OF TAMARAC, FLORIDA ' ORDINANCE No. 0-89- �(/ AN ORDINANCE OF THE CITY OF TAMARAC RELATING TO SIGNS; AMENDING SECTION 21-2 OF THE CITY CODE TO PROVIDE FOR AN AMENDED DEFINITION OF THE TERM "HEIGHT OF SIGN"; AMENDING SECTION 21-5 TO PROVIDE THE METHOD OF MEASURING SIGN HEIGHT IN A-1 ZONING DISTRICTS; AMENDING SECTION 21-7(A)(5) OF THE CITY CODE TO PROVIDE THAT TEMPORARY SIGN HEIGHT SHALL BE MEASURED FROM THE EDGE OF THE ROAD; CREATING SECTION 21-7(A)(20) ESTABLISHING CRITERIA FOR SIGNS LOCATED WITHIN THE PUBLIC RIGHT-OF-WAY; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 11, 1989 the Council of the City of Tamarac enacted a new comprehensive sign ordinance; and WHEREAS, the City has determined that some minor modifications must be made to that ordinance as enacted; and WHEREAS, the City Council of the City of Tamarac has determined that adoption of this ordinance is in the public interest: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Sec. 21-2 of the City Code of Ordinances entitled "Definitions" is hereby amended in part to read as follows: Sec. 21-2. Definitions. The following phrases, words and terms shall have the following meanings and basic limitations: sabalpalmsmotio 21 22 23 24 25 26 27 28 29 30 ?• 33 34 35 (40.) Height of Sign: Unless otherwise specified in this Ordinance, sign height shall be measured from the erewn of edge of the pavement in the adjacent roadway opposite the sign location. SECTION 2: That Sec. 21-5(B) of the City Code of Ordinances entitled "Signs Permitted in A-1 Zoning District" is hereby amended to read as follows: B. SIGNS PERMITTED IN A-1 ZONING DISTRICT 1. Identification Sign: Projects are permitted one monument sign, either nonilluminated or illuminated. Said sign shall not exceed twenty-four (24) square feet per sign face nor exceed an aggregate area of forty-eight (48) square feet nor exceed six (6) feet in height measured from erewn-ef-reed the ed a of the pavement. 2. Places of worship may have a changeable copy portion of the allowable sign area not to exceed 12 square feet. SECTION 3: That Sec. 21-7 of the City Code of Ordinances entitled "Construction, Location of Signs and Design" is hereby amended to read as follows: Sec. 21-7. CONSTRUCTION, LOCATION OF SIGNS AND DESIGN. A. Location of signs within the public right of way, In cases where a government is holding -road-right of way which is not yet being used for a street, applicant may reguest to locate a ground sign in that right of way, provided that the a2PIicant can meet the following criteria: (a) 2rovide a letter from the.government which owns the right _-__of - way that it does not object to the location of the ro osed ground sign in the right of way and as shown on the sightplan; and (b) provide a hold harmless agreement with the City of Tamarac and the government holding the right of way; and (c) rovide a non -lapsing bond to the City of Tamarac in 'the amount of 150 percent of the cost of removal of the sign; and (d) provide an agreement with the City that, when the owner of the right of way states its intention to use the right of way, the applicant will remove the sign within 10 days of notice from the owner of the right of way. SECTION 4 : Specific authority is hereby granted to codify this Ordinance. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. SECTION 6 : This Ordinance shall become effective immediately upon adoption and passage.
