Home My WebLink AboutCity of Tamarac Ordinance O-1989-042Temp, Ord. #1466 2 31 3 33 34 35 CITY OF TAMARAC, FLORIDA ORDINANCE N0. 0-89- Y'z AN ORDINANC'� AMENDING PRIOR ZONING ORDINANCES, Pr,_1DING FOR THE REZONING OF CERTAIN REAL PROPERTY FT_)M R-3 ( LOW DENSITY MULTIPLE DWELLING ) TO LI-1 (LIGHT INDUSTRIAL) TO CONFORM TO THE BROWARD COUNTY LAND USE PLAN; LANDS DES- CRIBED AS TRACT 8, SECTION 7, TOWNSHIP 49 SOUTH, RANGE 41 EAST, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 1, PAGE 102, OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA; OTHERWISE IDENTIFIED AS BEING LANDS ON THE SOUTH SIDE OF McNAB ROAD ADJACENT TO THE EXISTING SHOPPING CENTER AT THE SOUTHWEST CORNER OF MCNAB ROAD AND NOB HILL ROAD; PETITION #34-Z-89; PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding the zoning of the property described herein and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be and has been heard; and the Council has examined and investigated the request for the zoning herein and has received the recommendation of the Planning Commission of the City of Tamarac; and WHEREAS., public hearing has been held on Petition #34-Z-89 by the City Council, pursuant to the Charter. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That those lands described in Exhibit "A", attached hereto and made a part hereof, are hereby rezoned from R-3 (Low Density Multiple Dwellings) to LI-1 (Light Industrial) to conform to the Broward County Land Use Plan. SECTION 2: That the Official Zoning Map of the City of Tamarac shall be changed to reflect such zoning, said changes to be initialed 'by the Mayor and the City Clerk, together with the effective date of this Ordinance. Ord. #1466 SECTION 4: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction t be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
