AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA,
AMENDING ORDINANCE 0-89-23 CONCERNING A
REZONING REQUESTED BY FUNDAMENTAL HOPKINS
EASTON, LTD., #11 FOR A 4-ACRE PARCEL AT THE
SOUTHEAST CORNER OF VISUAL GRAPHICS PARK AT
COMMERCIAL BOULEVARD AND NW 94 AVENUE FROM
M-2 (MEDIUM INDUSTRIAL) TO B-3 (GENERAL
BUSINESS) TO PROVIDE FOR UTILIZING THE 20%
FLEXIBILITY PROVISION FOR COMMERCIAL USES IN
INDUSTRIAL LAND USE AREA AFTER THE ADOPTION
OF THE TAMARAC COMPREHENSIVE PLAN BY THE CITY
COUNCIL AND THE CERTIFICATION OF THE COMPRE-
HENSIVE PLAN BY THE BROWARD COUNTY PLANNING
COUNCIL; PETITION #14-Z-89; PROVIDING FOR
SEVERABILITY OF INVALID PROVISIONS; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council considered and approved the
rezoning from M-2 (Medium Industrial) to B-3 (General Business) of
a four -acre parcel at the southeast corner of Visual Graphics Park
at Commercial Boulevard and NW 94 Avenue at their meetings on
September 13 and September 27, 1989; and
WHEREAS, minutes of these meetings will reflect that it was
the City's intention to utilize 20% commercial flexibility to
accomplish the rezoning of this property more fully described on
Exhibit "A" attached hereto; and
WHEREAS, the minutes of those meetings will also reflect the
City's intention to make this zoning effective only upon certifica-
tion of the City's Comprehensive Plan by the Broward County Plan-
ning Council.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That Section 1 of Ordinance 0--89-23 is hereby
amended to read as follows:
"SECTION 1: That those lands described in
Exhibit "A" attached hereto and made a part
hereof are rezoned from M-2 (Medium Industrial)
to B-3 (General Business) utilizing the 20%
flexibility provision for commercial uses in
industrial land use area, after the adoption

of the Tamarac Comprehensive Plan by the City
Council and the certification of the Com2rehen-
sive�Plan by the Broward County Planning Council. "

SECTION 2: That Section 2 of Ordinance 0-89-23 is
hereby amended to read as follows:
"SECTION 2: That the Official Zoning Map of the
City of Tamarac shall be changed to reflect such
zoning and changes initialed by the Mayor and the
City Clerk, •together-with-t-he ef-fective date ef-
thie erdrnance after adoption of the Tamarac
Com2rehensive _Plan and approval of th_e20% flex-
ibility provision by the Braward County Planning
SECTION 3: That all other sections of Ordinance 0-89-23
shall remain in full force and effect.
SECTION 4: This Ordinance shall become effective immediately
upon adoption.
