AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES,
PROVIDING FOR THE REZONING OF CERTAIN REAL
PROPERTY FROM COUNTY RM-25 (PLANNED APART-
MENTS) TO CITY R-4A (PLANNED APARTMENTS) TO
CONFORM TO THE BROWARD COUNTY LAND USE PLAN
AND CITY OF TAMARAC CODE OF ORDINANCES; LANDS
DESCRIBED AS A PORTION OF TRACT 9 AND FURTHER
DESCRIBED AS GATE ONE, TWO, AND THREE CONDO-
MINIUMS OF FORT LAUDERDALE TRUCK FARMS
ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT
BOOK 4 AT PAGE 31 OF THE PUBLIC RECORDS OF
BROWARD COUNTY, FLORIDA; OTHERWISE DESCRIBED
AS THE SOUTHWEST CORNER OF ROCK ISLAND ROAD
AND BAILEY ROAD; PETITIONER: CITY OF TAMARAC;
PETITION # 13-Z-91; PROVIDING FOR AMENDMENT OF
THE OFFICIAL ZONING MAP TO REFLECT SUCH
CHANGE; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to the instruction of the City Council of
the City of Tamarac, Florida, public notice has been given in
accordance with the applicable law of the time and place of
public hearing regarding the zoning of the property described
herein and the said public hearing has been held in accordance
with the notice and the public has been given an opportunity to
be, and has been heard; and the Council has examined and
investigated the request for the zoning herein and has received
the recommendation of the Planning Commission of the City of
Tamarac; and
WHEREAS, public hearing has been held on Petition # 13-Z-91
by the City Council pursuant to the Charter.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That those lands described in Exhibit "A"
attached hereto and made a part hereto are hereby rezoned from
County RM-25 (Planned Apartments) to City R-4A (Planned Apart-
ments) to conform to the Broward County Land Use Plan and City of
Tamarac Code of Ordinances.
SECTION 2: That the official zoning map of the City of
Tamarac shall be changed to reflect such zoning, said changes to
be initialed by the Mayor and the City Clerk, together with the
effective date of this Ordinance.

SECTION 3: All Ordinances or parts of Ordinances in

conflict herewith are hereby repealed to the extent of such

conflict.

SECTION 4: Should any section or provision of this

I Ordinance or any portion thereof, or any paragraph, sentence or
word be declared by a Court of competent jurisdiction to be
1 invalid, such decision shall not affect the validity of the
Z remainder hereof as a whole or any part hereof, other than the
part declared to be invalid.
SECTION 5: This Ordinance shall become effective
immediately upon its final passage.
