CITY OF TAMARAC, FLORIDA
ORDINANCE No. 0-91- 2d
AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA,
AFFECTING THE LOCAL CODE ENFORCEMENT BOARDS
ACT PRESENTLY CODIFIED UNDER CHAPTER 162,
FLORIDA STATUTES; PROVIDING FOR THE ADOPTION
OF THE APPLICABLE MODIFICATIONS CONTAINED'IN
CHAPTER 89--268, .LAWS OF FLORIDA (1989) WHICH
EFFECtUATES SPECIFIC CHANGES IN CHAPTER 162,
FLORIDA STATUTES,AND TO INCORPORATE SAME INTO
CHAPTER 21 ARTICLE III, DIVISION 2 OF THE
TAMARAC CODE OF ORDINANCES; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR INCLUSION IN THE CODE; AND
WHEREAS, the City of Tamarac has adopted and implemented a
Municipal Code Enforcement Board pursuant to Chapter 162, Florida
Statutes, as amended,
WHEREAS, the Florida Legislature has, from time to time,
reviewed and amended Chapter 162, Florida Statutes and has altered
the powers, duties, and authority of the Municipal Code
Enforcement Board; and
WHEREAS, the Florida Legislature has adopted Chapter 89-268,
Laws of Florida (1989) which substantially modified Chapter 162,
Florida Statutes, known as the "Local Government Code Enforcement
Boards Act" (the "Act") effective October 1, 1989; and
WHEREAS, the City Council finds and determines that the
changes and modifications to the Act require corresponding
modifications to the. City of Tamarac Code of Ordinances to
promote, protect, and to improve the health, safety, and welfare
of the citizens and residents of the City of Tamarac, Florida;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC THAT:

ratified and confirmed as being true and correct and are hereby
.made a part of this Ordinance upon adoption hereof.

Spintinn 2. That Sections 2-71, 2-72, 2-74, 2-75, 2-76,
2-77, 2-78, 2-79, 2-80, 2-81, 2-82, 2-83, 2-84, 2-85, 2-86, 2-87,
2-88, and 2-89 hereby are repealed in their entirety.
Section 1. There hereby is created a new Section 2-71
which shall read as follows:
Section_4. There hereby is created a new Section 2-72
which shall read as follows:

Section k - There hereby is created a new Section 2-74
which shall read as follows:

,Spction 7. All sections or parts of sections of the Code
of Ordinances, all ordinances or parts of ordinances and all
resolutions or parts of resolutions in conflict herewith, be and
the same, are hereby repealed to the extent of such conflicts.
.9ect,on S. Should any section or provision of this
ordinance, or any portion thereof, or any paragraph, sentence or
word be declared by a Court of competent jurisdiction "to be
invalid, such decision shall not affect the validity of the
remainder hereof, as a whole or a part hereof, other than the part
declared to be invalid.

the provisions of this Ordinance shall become and be made a part
of the Code of Ordinances and that the sections of this ordinance
may be renumbered or relettered and the words "Ordinance" may b4
changed to "Chapter", "Section", "Article" or such othe:
appropriate word or phrase, the use of which shall accomplish th
intentions herein expressed.
This Ordinance shall be in force and tak
full effect immediately upon its passage and final adoption.
