Ord. # '15G� 3 0 ■, CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0--91- _.�6 AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 2, "ADMINISTRA- TION", ARTICLE III, "BOARDS, COMMITTEES, COMMISSIONS" BY CREATING A NEW DIVISION 9, "URBAN FORESTRY COMMITTEE" TO REVIEW, STUDY, INVESTIGATE AND DEVELOP WRITTEN PLANS AND PROGRAMS FOR THE CARE, PRESERVATION, PRUN ING, PLANTING, REPLANTING, REMOVAL OF TREES AND SHRUBS IN PARKS, PUBLIC RIGHTS -OF WAY AND OTHER PUBLIC AREAS; PROVIDING FOR ITS MEMBERSHIP, POWERS AND DUTIES; AND PROVIDING FOR CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Tamarac City Council. is desirous of improv- ing various areas within the City of Tamarac by adopting and promoting proper Urban and Community Forestry Practices= WHEREAS, the Tamarac City Council has recognized the need to establish an Urban Forestry Committee to promote proper urban and community forestry practices; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1. : Chapter 2, Article III of the Tamarac City Code is hereby amended by creating a new Division 9 which shall read as follows: DIVISION 9 URBAN FORESTRY COMMITTEE SECTION 2-230 Creation and Membership of Committee. There is hereby created and established an Urban Forestry Committee which shall be a permanent aaenc of the City, and shall consist of not less than four (4) members consisting of two (2) staff members appointedby the City -Manager and two (2) residents a220inted annual] b the City Council. The Committee shall. Promulgate its rules and order of procedure which shall comply with all applicable laws. Committee members shall serve without compensation. • !7 SECTION 2--231 : Powers and Duties . The Committee shall be authorized to make al.l. studies relating to tree care and preservation with articular emphasis on tree pruning. P_lantinq, replanting, removal of trees and shrubs in parks, public rights -of -way And other.public areas, inc3udin2 conservation of natural resources relatin2 to mulching and com ostin of tree and plant material; submit to the Council appropriate recommenda- tions for programs designed to irn lement such studies= recommend such legislation as they shall, deem necessary or advisable; cooperate with a11_ other similar governmental agencies, and all. other public orrivate organizations working for the same or similar objec- tives. The committee_ when. requested by the City Council or City Manager, shall. consider, investigate, make findings and report and recommend upon an s ecial - -g �.,_, matter _or_question com n w th n the scope of its work. SECTION 2--232 : Requirements : Members of the committee must have experience (working knowledge) in one or more of the following fields:- horticulture, landscaping, forestry or ecology. SECTION 3 : Specific authority is hereby granted to codify this Ordinance. SECTION 4 : All. ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. 3 2 3 i 7 d 49 2 3 a4 I I !7 t� 19 10 12 1: 13 14, �S SECTION 5 If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable SECTION 6 : This Ordinance shall become effective immediately upon adoption and passage. to PASSED FIRST READING this 4-Z(v day of 1991.
