Ord. #1,6o;�- Revised 5/13 91 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-91-w� AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA, AMENDING SECTION 14-37 OF CHAPTER 14 OF THE CODE OF ORDINANCES, ENTITLED "MOTOR VEHICLES AND TRAFFIC", TO CHANGE THE PENALTY PROVISIONS OF THAT CHAPTER, AS THEY RELATE TO CODE SECTIONS 14--4, 14-26, 14-27, 14-28, 14-29 AND 14-30; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Sections 14-29(e) and 14-37 of the Code of Ordinances of the City of Tamarac contain the penalties for the unlawful parking in places designated for disabled persons, and for other parking violations; and WHEREAS, the City Council of the City of Tamarac finds and determines that upon periodic review of the penalties and fines and the appropriateness of the amount thereof, said fines should be amended to be in conformity with those generally applicable within Broward County, Florida; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA THAT: SECTION 1 Section 14-37 of the Code of Ordinances of the City of Tamarac hereby is amended to read as follows: (a) Violation Any u"autherized person parking in conflict with this article shall be guilty of a non -criminal parking infraction. If the cause is brought to trial the maximum penalty shall be one hundred dollars ($100.00). Notwithstanding anything to the contrary contained herein, as to citations issued in connection with disabled parking spaces,__ the fines set forth in Section 14 29(e) shall be assessed for violations of Section 14--29. (d) Refusal to acre t and sign citation or notice to appear. SECTION 3 : Should any section or provision of this ordinance, or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall be affect the validity of the remainder hereof, as a whole or a part hereof, other than the part declared to be invalid. SECTION 4 : It is the intention of the City Council that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances and that the sections of this ordinance may be renumbered or relettered and the words "Ordinance" may be changed to "Chapter, "Section", "Article" or such other appropriate word or phrase, the use of which shall accomplish the intentions herein expressed.
